TO THE <br />APPROXIMATE DI <br />Mr. Leszczynsk <br />Board's Public <br />follows: <br />AVORABLE RECOMMENDATION - STREET V <br />RI <br />FROM THE NORTHE <br />-OF-WAY _LINE OF <br />IGHT-OF-WAY OF <br />9 <br />advised that this was the date set for the <br />Hearing on a proposed vacation described as <br />AN <br />Scott Street running North from the northerly right-of-way of <br />Lincolnway West to the South right-of-way line of Marion <br />Street extended West, for an approximate distance of 107 feet <br />all within the City of South Bend, Indiana and being parts of <br />Kent & Garrison and Smith & Jackson subdivisions. <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by William J. Paulson, <br />5711 Hermosa Vista, Mesa, Arizona with the local contact person <br />regarding this vacation being Mr. Mike W. Dobson, 207 Dixieway <br />North, Room #134, South Bend, Indiana. It was further noted that <br />pursuant to South Bend Municipal Code Section 18-53.8, owners <br />whose property abut the proposed street to be vacated were <br />notified of the Board's Public Hearing date. <br />Mr. Glenn Moody, 418 Madison Street, South Bend, Indiana, advised <br />the Board that he utilizes the shopping center at L.W.W. and <br />Cushing and walks or rides his bicycle to get there. He stated <br />that closing the portion of Scott Street referred to above is an <br />unnecessary restriction of his right of access to the shopping <br />center. Mr. Moody further questioned the validity of the <br />Vacation Petition which was signed by only Mr. Paulson. He <br />further informed the Board that vehicular traffic is already <br />prohibited due to the barricade that closes Scott Street at <br />L.W.W. <br />Mr. Paul Rohleder, 722 Harrison Street, South Bend, Indiana, <br />advised the Board that he was present representing the Near <br />Northwest Neighborhood Association as well as being a member of <br />the L.W.W. Business Association and stated that they are in <br />support of the Petition to vacate. Mr. Rohleder submitted to the <br />Board three (3) photographs of the portion of Scott Street to be <br />vacated and indicated that the City is not maintaining the <br />barricade and the catch basins. He further indicated that he <br />would request that Mr. Paulson, Petitioner, also vacate the <br />alleyway and install a privacy fence which would become an asset. <br />Mr. Mike W. Dobson, 207 Dixieway North, Room 134, South Bend, <br />Indiana, Contact person in this Vacation Petition, was present <br />and addressed the Board. He stated that the intent of the <br />vacation is to reduce the traffic using Lot #6 as an <br />I <br />
