RESOLUTION NO. <br />A RESOLUTION OF THE COMMON COUNCIL OF THE CITY <br />OF SOUTH BEND, INDIANA, APPROVING PARKING RATES, CHARGES, AND <br />RULES FOR PUBLICLY -OWNED PARKING FACILITIES IN THE CITY OF SOUTH <br />BEND, INDIANA <br />WHEREAS, pursuant to Ind. Code 36- 9 -11 -7, on September 27, 2016, the Board of <br />Public Works of the City of South Bend, Indiana, adopted its Resolution No. 42 -2016, attached <br />hereto as Exhibit A (the "BPW Resolution "), establishing certain rates, charges, and rules for the <br />use and operation of publicly -owned parking facilities located in the City of South Bend; and <br />WHEREAS, the Common Council desires to approve the rates, charges, and rules stated <br />in the BPW Resolution, in accordance with Ind. Code 36- 9- 11 -7(a). <br />NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF <br />THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: <br />Section I. The rates, charges, and rules set forth in the BPW Resolution are approved and <br />shall be effective on the date stated in the BPW Resolution. <br />Section II. The approval of rates, charges, and rules stated herein supersedes all prior <br />ordinances and resolutions of the Common Council approving rates, charges, and rules for <br />publicly -owned parking facilities, including, without limitation, Ordinance Nos. 9845 -08 and <br />9397 -03. <br />Section III.
