MIN <br />REGULAR MEETING <br />JUNE 9, 1987 <br />ADOPTION OF RESOLUTION NO. 13-1987 - A JOINT RESOLUTION OF THE <br />BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND AND THE BOARD OF <br />PARK COMMISSIONERS CONVEYING AND ACCEPTING CERTAIN REAL PROPERTY <br />FOR PURPOSES OF THE EAST BANK TRAIL PROJECT <br />Assistant City Attorney Brian Long advised the Board that the <br />Joint Resolution referred to above and submitted to the Board for <br />approval involves a strip of land that has come under the <br />ownership of the City. He stated that the property was formerly <br />Conrail right-of-way near Pokagon and Angela Boulevard. This <br />strip of property came into the City's possession when the <br />railroad abandoned the property in 1982. The City, is the <br />adjacent property owner of another parcel of property formerly <br />abandoned by another railroad. The property referred to in <br />Resolution No. 13-1987 will be utilized for a segment of the East <br />Bank Trail. <br />Therefore, upon a motion made by Mrs. DeClercq, seconded by Mr. <br />Leszczynski and carried, the following Board of Public Works <br />Resolution No. 13-1987 was adopted: <br />A JOINT RESOLUTION OF THE <br />BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND <br />AND THE BOARD OF PARK COMMISSIONERS OF THE <br />PARK DISTRICT OF THE CITY OF SOUTH BEND <br />CONVEYING AND ACCEPTING CERTAIN REAL PROPERTY <br />FOR PURPOSES OF THE EAST BANK TRAIL PROJECT <br />RESOLUTION NO. 13-1987 OF THE BOARD OF PUBLIC WORKS <br />WHEREAS, the Board of Public Works of the City of South Bend <br />(Board of Works) owns in fee simple certain real property within <br />the City of South Bend, more fully described in Exhibit A <br />attached hereto and made a part hereof this resolution; and <br />WHEREAS, the Board of Park Commissioners of the Park <br />District of the City of South Bend (Park Board) desires to accept <br />the real property described in Exhibit A (Property) for purposes <br />of establishing a new park known as the East Bank Trail within <br />the City of South Bend; and <br />WHEREAS, I.C. 36-1-11-8 permits the transfer or exchange of <br />property from one governmental entity to another through adoption <br />of substantially identical resolution by each entity. <br />NOW, THEREFORE, BE IT RESOLVED BY the Board of Public Works <br />of the City of South Bend and the Board of Park Commissioners of <br />the Park District of the City of South Bend, as follows: <br />1. The Board of Works determines that it has no further <br />need or use for the Property and that it is advisable and <br />desirable to convey the Property for purposes of the East Bank <br />Trail. <br />2. The Park Board determines that it is advisable and <br />necessary to accept from the Board of Works the Property for <br />purposes of the East Bank Trail. <br />3. The President of <br />the Board <br />of Works <br />shall have authority <br />to execute the deed for the <br />Property <br />and <br />any other documents <br />needed to carry out fully <br />the intent <br />of <br />this resolution. <br />4. The President of <br />the Park Board <br />shall have the authority <br />to accept the deed for the <br />Property <br />and <br />to execute any other <br />documents needed to carry <br />out fully <br />the <br />intent of this <br />resolution. <br />
