37 <br />REGULAR MEETING MAY 12, 1987 <br />The regular meeting of the Board of Public Works was convened at <br />9:37 a.m. on Tuesday, May 12, 1987, by President John E. <br />Leszczynski, with Mr. Leszczynski, Mrs. Patricia E. DeClercq <br />and Mr. Michael L. Vance present. Also present was Chief Deputy <br />City Attorney Thomas Bodnar. <br />APPROVE MINUTES OF PREVIOUS MEETING <br />Upon a motion made by Mrs. DeClercq, seconded by Mr. Leszczynski, <br />and carried, the minutes of the May 5, 1987, regular meeting of <br />the Board were approved. <br />APPROVE COMMUNITY DEVELOPMENT ADDENDA <br />The following Community Development Addenda were presented to the <br />Board for approval: <br />ADDENDUM II (CD 79-114) <br />NEIGHBORHOOD HOUSING SERVICES OF SOUTH BEND, INC. <br />NHS REVOLVING LOAN FUND ACTIVITY <br />ADDENDUM II (CD 80/81-114) <br />NEIGHBORHOOD HOUSING SERVICES OF SOUTH BEND, INC. <br />NHS REVOLVING LOAN FUND ACTIVITY <br />Ms. Betsy Harriman, Department of Community Development, advised <br />that these addenda extend the contract time to December 31, 1987 <br />and clarify the use of "revolved" funds. It was noted that the <br />Contracts were originally approved in 1979 and 1980. <br />Upon a motion made by Mr. Vance, seconded by Mrs. DeClercq and <br />carried, the above addenda were approved and executed. <br />APPROVE CONTRACT FOR COLLECTION SERVICES - FIRE DEPARTMENT PAST <br />DUE AMBULANCE ACCOUNTS <br />Fire Chief Luther Taylor advised that the Department solicited <br />proposals from three (3) local agencies for debt collection for <br />past due ambulance accounts. Two (2) replies were received. <br />Based on a lower fee rate, Chief Taylor recommended that a <br />Contract be awarded to Federated Collection Agency, Suite 138, <br />Marycrest Building, 2015 West Western Avenue, South Bend, <br />Indiana, as the agent for the collection of past due ambulance <br />accounts. <br />In response to Mr. Vance's inquiry, Chief Taylor advised that the <br />Contract is currently held by Federated Collection Agency. <br />The Contract indicates that Federated shall retain thirty-five <br />per cent (35%) of all money recovered toward satisfaction of said <br />accounts as compensation for services. Fees will not be assessed <br />on unrecovered funds. <br />In response to a question from the news media, Assistant Chief <br />Daniel Marocha advised that he is unable to advise what the total <br />amount of uncollected fees is at this time. <br />Therefore, upon a motion made by Mrs. DeClercq, seconded by Mr. <br />Vance and carried, the Contract as submitted was approved and <br />executed. <br />APPROVE LETTER OF ASSURANCE TO COMPLY - INDIANA DEPARTMENT OF <br />HIGHWAYS <br />Mr. Leszczynski advised that as a formality the City needs to <br />provide to the Indiana Department of Highways assurance that when <br />federal funds are involved in any project or program which <br />results in real property acquisition or displacement, the City of <br />South Bend, will comply with the Uniform Relocation Assistance <br />and Real Property Acquisition Policies Act of 1970 and 49 CRF <br />Part 25, Final Rule dated February 27, 1986. <br />
