73 REGULAR MEETING DECEMBER 19, 1988 The regular meeting of the Board 9:33 a.m. on Monday, December 19, Leszczynski with Mr. Leszczynski, Ms. Katherine Humphreys present. Attorney Marva J. Leonard -Dent. of Public Works was convened at 1988 by Board President John E. Mrs. Patricia E. DeClercq and Also present was Assistant City APPROVE MINUTES OF PREVIOUS MEETING Upon a motion made by Mrs. DeClercq, seconded by Ms. Humphreys and carried, the minutes of the regular meeting of the Board of Public Works held on December 12, 1988 were approved. ADOPTION OF RESOLUTION NO. 38-1988 - TERMINATION OF LEASE (303 EAST LA SA] Upon a motic and carried, E) n made by Mrs. DeClercq, seconded by Ms. Humphreys the following Resolution No. 38-1988 was adopted: RESOLUTION NO. 38-1988 RESOLUTION CONFIRMING TERMINATION OF LEASE WHEREAS, the City of South Bend, Department of Redevelopment, by its Redevelopment Commission, as Lessor and the South Bend Board of Public Works, as Lessee entered into a commercial lease on January 1, 1985; and, WHEREAS, said commercial lease was approved by the Board of Public Works on December 31, 1984; and, WHEREAS, said commercial lease involves real estate located in St. Joseph County, State of Indiana, known and described as follows: A lot or parcel of land 119 feet, East and West, and 60 feet in width, North and South, taken off of the West end of Lot Numbered Twelve (12) in the Original Plat of the Town of Lowell, now part of the City of South Bend, Indiana, including the East one-half of vacated Sycamore Street in the City of South Bend, St. Joseph County, Indiana, more particularly described as follows: Beginning at the Southwest corner of Lot Numbered Twelve (12); thence East along the South line of said Lot Numbered Twelve (12) a distance of 86 feet to a point; thence North parallel to and 86 feet East of the West line of said Lot 12, a distance of 60 feet to a point; thence West along a line 60 feet North of and parallel to the South line of said Lot 12 a distance of 119 feet to the center of vacated Sycamore Street in the City of South Bend; thence South along the center line of said vacated Sycamore Street a distance of 60 feet; thence East 33 feet to the place of beginning. WHEREAS, said structure was used as a South Bend Police Department substation; and, WHEREAS, said structure has been vacated since on or about February 1987 when said structure was demolished; and, WHEREAS, City of South Bend, Department of Redevelopment, by its Redevelopment Commission, wishes to make other use of the real estate described herein, and that the lease described herein is a cloud upon said title; and, WHEREAS, the City of South Bend, Department of Public Works, wishes to make public record and notify all parties that said lease is terminated.
