REGULAR MEETING NOVEMBER 14, 1988 RIETH-RILEY CONSTRUCTION COMPANY, INC. P.O. Box 1775 South Bend, Indiana 46634 Bid was signed by Richard A. Jankowski, Area Manager, Non -Collusion Affidavit was in order and a 5% Bid Bond was submitted. BID: $32,737.00 Upon a motion made by Mr. Leszczynski, seconded by Mrs. DeClercq and carried, the bids were referred to the Engineering Department for review and recommendation. PUBLIC HEARING AND FAVORABLE RECOMMENDATIONS - STREET AND ALLEY VACATIONS• - HULL STREET RUNNING BETWEEN FRANCES AND EDDY STREETS - 1ST N/S ALLEY EAST OF FRANCES STREET RUNNING N. FROM HULL STREET Mr. Leszczynski advised that this was the date set for the Board's Public Hearings on the proposed street and alley vacations as follows: Hull Street running between Frances Street and Eddy Street. The 1st north/south alley, east of Frances Street, running North from Hull Street, for a distance of 83 feet to the first intersecting east/west alley, all in Hull's Subdivision of Large Block #11 in Samuel L. Cottrell's 1st Addition. It was noted that the Public Hearings are being held in order for the Board to submit a recommendation to the Common Council concerning the Vacation Petitions filed by Mr. Christopher J. Matteo, 4104 St. Andrews Circle, Apartment 2C, Mishawaka, Indiana and the Taripp Development Corporation, c/o Mr. Christopher J. Matteo, 807 East Jefferson Boulevard, South Bend, Indiana. It was further noted that pursuant to South Bend Municipal Code Section 18-53.8, owners whose property abut the proposed street and alley to be vacated as well as those within fifty (50) feet of the street and alley to be vacated were notified of the Board's Public Hearing date. Mr. Leszczynski stated that as the Petitions are closely related, they would be combined into one (1) Public Hearing at this time. Mr. Geoffrey I. Newman, 1215 Garway Common, South Bend, Indiana, addressed the Board and advised that he owns Lot Nos. 21 and 22 located at 414 Frances Street. He also advised that he is a member of the Board of Directors of Youth Facilities, Inc. owners of Lot Nos. 23 and 24. Mr. Newman informed the Board that he personally has no objections to the development proposed for the area. His concern, however, is access to garages that abut Hull Street as their only access is provided off of Hull Street. Mr. Newman also advised the Board that DuComb Center is located on Lot Nos. 23 and 24. He stated that the program requires access to their garage and also that trash is picked -up in the rear of these properties. Mr. Newman advised the Board that it is his understanding that should Hull Street be vacated, the property owner on the south will receive a twenty (20) foot strip of the street and that the property owners on the north will each receive a portion of the twenty (20) feet abutting their property.
