Jankowski, Area Manager, <br />Non -Collusion Affidavit was in order and a 5% Bid Bond was <br />submitted. <br />BID: $32,737.00 <br />Upon a motion made by Mr. Leszczynski, seconded by Mrs. DeClercq <br />and carried, the bids were referred to the Engineering Department <br />for review and recommendation. <br />PUBLIC HEARING AND FAVORABLE RECOMMENDATIONS - STREET AND ALLEY <br />VACATIONS• <br />- HULL STREET RUNNING BETWEEN FRANCES AND EDDY STREETS <br />- 1ST N/S ALLEY EAST OF FRANCES STREET RUNNING N. FROM HULL <br />STREET <br />Mr. Leszczynski advised that this was the date set for the <br />Board's Public Hearings on the proposed street and alley <br />vacations as follows: <br />Hull Street running between Frances Street and <br />Eddy Street. <br />The 1st north/south alley, east of Frances Street, <br />running North from Hull Street, for a distance of <br />83 feet to the first intersecting east/west alley, <br />all in Hull's Subdivision of Large Block #11 in Samuel <br />L. Cottrell's 1st Addition. <br />It was noted that the Public Hearings are being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petitions filed by Mr. Christopher J. <br />Matteo, 4104 St. Andrews Circle, Apartment 2C, Mishawaka, Indiana <br />and the Taripp Development Corporation, c/o Mr. Christopher J. <br />Matteo, 807 East Jefferson Boulevard, South Bend, Indiana. It <br />was further noted that pursuant to South Bend Municipal Code <br />Section 18-53.8, owners whose property abut the proposed street <br />and alley to be vacated as well as those within fifty (50) feet <br />of the street and alley to be vacated were notified of the <br />Board's Public Hearing date. <br />Mr. Leszczynski stated that as the Petitions are closely related, <br />they would be combined into one (1) Public Hearing at this time. <br />Mr. Geoffrey I. Newman, 1215 Garway Common, South Bend, Indiana, <br />addressed the Board and advised that he owns Lot Nos. 21 and 22 <br />located at 414 Frances Street. He also advised that he is a <br />member of the Board of Directors of Youth Facilities, Inc. owners <br />of Lot Nos. 23 and 24. <br />Mr. Newman informed the Board that he personally has no <br />objections to the development proposed for the area. His <br />concern, however, is access to garages that abut Hull Street as <br />their only access is provided off of Hull Street. Mr. Newman <br />also advised the Board that DuComb Center is located on Lot Nos. <br />23 and 24. He stated that the program requires access to their <br />garage and also that trash is picked -up in the rear of these <br />properties. <br />Mr. Newman advised the Board that it is his understanding that <br />should Hull Street be vacated, the property owner on the south <br />will receive a twenty (20) foot strip of the street and that the <br />property owners on the north will each receive a portion of the <br />twenty (20) feet abutting their property. He further advised <br />that Hull Street is not open to Frances Street and that <br />the only access is off of Eddy Street. He stated that the <br />
