5W REGULAR MEETING OCTOBER 24, 1988 After review of the Proposals, Mrs. DeClercq recommended awarding the Proposal submitted by Midwest Collection Services, Inc., and entering into the six (6) month Contract submitted today. Mrs. DeClercq stated that at the end of the six (6) month period, the Department will assess the performance of Midwest Collection Services and determine whether to extend the Contract for a full year. In response to questions from South Bend Tribune Reporter James Wensits, Mrs. DeClercq advised that Midwest shall retain forty per cent (40%) for accounts under six (6) months old and fifty per cent (50%) for any account over six (6) months old or transferred to another agency or for any account sent to an attorney for collection as compensation for Midwest's services. Mrs. DeClercq further advised Mr. Wensits that the City does attempt to collect before accounts are turned over to the collection agency with that attempt taking less than six (6) months. Therefore, upon a motion made by Mrs. DeClercq, seconded by Ms. Humphreys and carried, the Proposal was awarded and the appropriate Contract for Collection Services approved and executed. APPROVE PROPOSAL WITH COLE ASSOCIATES - MUNICIPAL SERVICES FACTT.TTY Mr. Leszczynski advised that Cole Associates, Inc., 2211 East Jefferson Boulevard, South Bend, Indiana, has submitted a consultant agreement not to exceed $16,500.00 to look at the ventilation problem at the Municipal Services Facility as well as reuse of the building and the possible need for a new maintenance garage. Ms. Katherine Humphreys, Director, Administration and Finance, responded to questions from the news media and stated that the City has done a lot of consolidation of its vehicle maintenance and the adequacy of the Municipal Services Building is questionable. Mr. Leszczynski further advised that the study outlined in the Proposal submitted today will begin immediately. Therefore, upon a motion made by Ms. Humphreys, seconded by Mrs. DeClercq and carried, the Proposal as submitted was approved and executed. APPROVE PROJECT COMPLETION AFFIDAVIT - SOUTHEAST ESTATES. SECTION #6 Mr. Leszczynski advised that Donald E. Jankowski, Executive Vice -President, Portage Realty Corporation, submitted to the Board for approval a Project Completion Affidavit and Maintenance Bond for improvements completed at Southeast Estates, Section #6, Georgian Drive and Georgian Court. The Project Completion Affidavit indicated that the final cost of improvements is $59,834.15 which entailed water main installation by H. DeWulf in the amount of $24,358.15 and paving by Michiana Paving in the amount of $35,476.00 serving lots #60 through #65 and #70 through #83. Therefore, upon a motion made by Mr. Leszczynski, seconded by Mrs. DeClercq and carried, the Project Completion Affidavit as submitted was approved and executed and the Maintenance Bond accepted for filing. APPROVE CONTRACT BOND - PORTAGE REALTY CORPORATION (SOUTHEAST ESTATES, SECTION #6) Mr. Leszczynski advised that Mr. Michael P. Meeks, Director, Division of Engineering, has submitted to the Board a Contract Bond as submitted by Portage Realty Corporation and American States Insurance Company as surety for construction of sidewalks in Southeast Estates, Section #6, in the City of South Bend. Mr. Meeks noted that the Bond is to be retained by the Board until such time as sidewalks are completed or the bond is replaced (partial completion) with another Bond. Therefore, upon a motion made by Mr. Leszczynski, seconded by Mrs. DeClercq and carried, the Contract Bond as submitted was approved.
