r <br />REGULAR MEETING <br />OCTOBER 17, 1988 <br />The regular meeting of the Board <br />9:33 a.m. on Monday, October 17, <br />Leszczynski with Mr. Leszczynski, <br />Ms. Katherine Humphreys present. <br />Attorney Marva Leonard -Dent. <br />of Public Works was convened at <br />1988 by Board President John E. <br />Mrs. Patricia E. DeClercq and <br />Also present was Assistant City <br />AGENDA ITEM ADDED <br />Upon a motion made by Mr. Leszczynski, seconded by Mrs. DeClercq <br />and carried, Resolution No. 30-1988 - Joint Resolution of the <br />South Bend Redevelopment Commission and the Board of Public Works <br />regarding the Skywalk from the Marriott Hotel to the Century <br />Center, was added to the agenda. <br />APPROVE MINUTES OF PREVIOUS MEETING <br />Upon a motion made by Mrs. DeClercq, seconded by Ms. Humphreys <br />and carried, the minutes of the regular meeting of the Board of <br />Public Works held on October 10, 1988 were approved. <br />PUBLIC HEARING AND FAVORABL <br />14-FT. WIDE E/W ALLEY N. OF <br />RECOMMENDATION - ALLEY VACATION: 1ST <br />W. FROM BRI <br />(VACATED) FOR A DISTANCE OF APPROX. 66 FT. <br />Mr. Leszczynski advised that this was the date set for the <br />Board's Public Hearing on a proposed alley vacation described as <br />follows: <br />The first 14-foot wide east/west alley north of <br />Colfax Avenue, west from Bridge Street (vacated) for <br />a distance of approximately 66 feet. All being in a <br />part of the Original Plat of the Town of Lowell, now <br />a part of the City of South Bend, Indiana. <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by Mr. Jeffery N. Reece, <br />Senior Property Representative, Indiana Michigan Power Company, <br />One Summit Square, P.O. Box 60, Fort Wayne, Indiana. It was <br />further noted that pursuant to South Bend Municipal Code Section <br />18-53.8, owners whose property abut the proposed alley to be <br />vacated as well as those within fifty (50) feet of the alley to <br />be vacated were notified of the Board's Public Hearing date. <br />Mr. Jeffery N. Reece, Senior Property Representative, Indiana <br />Michigan Power Company, was present and addressed the Board. Mr. <br />Reece advised that I&M's review of its inventory of property <br />indicates that the above referred to alley was vacated in the <br />late 1920's. However, as verification of the vacation could not <br />be located, I&M has now petitioned to have the alley re -vacated. <br />Mr. Reece informed the Board that I&M is the owner of Lot No. 13 <br />and the lots south of the alley to Colfax. He stated that they <br />own the parking garage on Lot No. 13 which is leased to the <br />Chamber of Commerce. Mr. Reece reiterated that they desire to <br />get verification into the record of the alley vacation as a <br />building is already across the alley. <br />Attorney Kevin Butler, One Michiana Square, South Bend, Indiana, <br />advised that he was present on behalf of Mr. Bert Liss, 701 Niles <br />Avenue, South Bend, Indiana, owner of Lot No. 14. Mr. Butler <br />stated that he has discussed this vacation with Mr. Reece to <br />insure that just that portion of the alley as indicated in the <br />Petition, which is located to the south of Lot No. 13, would be <br />vacated. Mr. Reece assured Mr. Butler that he was correct and <br />Mr. Butler advised that he therefore has no objections. <br />There being no one else present wishing to speak either for or <br />against the proposed alley vacation, and no written objections <br />having been filed with the Board, upon a motion made by Mr. <br />Leszczynski, seconded by Mrs. DeClercq and carried, the Public <br />Hearing on this matter was closed. <br />1 <br />[1 <br />
