r REGULAR MEETING OCTOBER 17, 1988 The regular meeting of the Board 9:33 a.m. on Monday, October 17, Leszczynski with Mr. Leszczynski, Ms. Katherine Humphreys present. Attorney Marva Leonard -Dent. of Public Works was convened at 1988 by Board President John E. Mrs. Patricia E. DeClercq and Also present was Assistant City AGENDA ITEM ADDED Upon a motion made by Mr. Leszczynski, seconded by Mrs. DeClercq and carried, Resolution No. 30-1988 - Joint Resolution of the South Bend Redevelopment Commission and the Board of Public Works regarding the Skywalk from the Marriott Hotel to the Century Center, was added to the agenda. APPROVE MINUTES OF PREVIOUS MEETING Upon a motion made by Mrs. DeClercq, seconded by Ms. Humphreys and carried, the minutes of the regular meeting of the Board of Public Works held on October 10, 1988 were approved. PUBLIC HEARING AND FAVORABL 14-FT. WIDE E/W ALLEY N. OF RECOMMENDATION - ALLEY VACATION: 1ST W. FROM BRI (VACATED) FOR A DISTANCE OF APPROX. 66 FT. Mr. Leszczynski advised that this was the date set for the Board's Public Hearing on a proposed alley vacation described as follows: The first 14-foot wide east/west alley north of Colfax Avenue, west from Bridge Street (vacated) for a distance of approximately 66 feet. All being in a part of the Original Plat of the Town of Lowell, now a part of the City of South Bend, Indiana. It was noted that this Public Hearing is being held in order for the Board to submit a recommendation to the Common Council concerning the Vacation Petition filed by Mr. Jeffery N. Reece, Senior Property Representative, Indiana Michigan Power Company, One Summit Square, P.O. Box 60, Fort Wayne, Indiana. It was further noted that pursuant to South Bend Municipal Code Section 18-53.8, owners whose property abut the proposed alley to be vacated as well as those within fifty (50) feet of the alley to be vacated were notified of the Board's Public Hearing date. Mr. Jeffery N. Reece, Senior Property Representative, Indiana Michigan Power Company, was present and addressed the Board. Mr. Reece advised that I&M's review of its inventory of property indicates that the above referred to alley was vacated in the late 1920's. However, as verification of the vacation could not be located, I&M has now petitioned to have the alley re -vacated. Mr. Reece informed the Board that I&M is the owner of Lot No. 13 and the lots south of the alley to Colfax. He stated that they own the parking garage on Lot No. 13 which is leased to the Chamber of Commerce. Mr. Reece reiterated that they desire to get verification into the record of the alley vacation as a building is already across the alley. Attorney Kevin Butler, One Michiana Square, South Bend, Indiana, advised that he was present on behalf of Mr. Bert Liss, 701 Niles Avenue, South Bend, Indiana, owner of Lot No. 14. Mr. Butler stated that he has discussed this vacation with Mr. Reece to insure that just that portion of the alley as indicated in the Petition, which is located to the south of Lot No. 13, would be vacated. Mr. Reece assured Mr. Butler that he was correct and Mr. Butler advised that he therefore has no objections. There being no one else present wishing to speak either for or against the proposed alley vacation, and no written objections having been filed with the Board, upon a motion made by Mr. Leszczynski, seconded by Mrs. DeClercq and carried, the Public Hearing on this matter was closed. 1 [1
