ME <br />REGULAR MEETING <br />AUGUST 22, 1988 <br />The regular meeting of the Board of Public Works was convened at <br />9:34 a.m. on Monday, August 22, 1988, by Board President John E. <br />Leszczynski, with Mr. Leszczynski, Mrs. Patricia E. DeClercq and <br />Ms. Katherine Humphreys present. Also present was Assistant City <br />Attorney Marva Leonard -Dent. <br />APPROVE MINUTES OF PREVIOUS MEETING <br />Upon a motion made by Mrs. DeClercq, seconded by Ms. Humphreys <br />and carried, the minutes of the regular meeting of the Board held <br />on August 15, 1988 were approved. <br />PUBLIC HEARING AND <br />THE DEDICATED BUT <br />PARK <br />Mr. Leszczynski advised <br />Board's Public Hearing <br />street: <br />LE RECOMMENDATION - STREET VACATION: <br />ED RIGHT-OF-WAY FOR A STREET NAMED <br />BUSINESS <br />that this was the date set for the <br />on the proposed vacation of the following <br />That dedicated but unimproved right-of-way for a street <br />named "Clark Drive" as shown on the recorded plat of <br />Landmark Business Park. The dedicated but unimproved <br />right-of-way runs westwardly from Technology Drive <br />approximately 435 feet to the eastern boundary line of Lot <br />7, Landmark Business Park, Section 1, owned by Clark <br />Information Technologies, and is bounded on the north by a <br />parcel to be platted as Lot 9, Landmark Business Park, owned <br />by James P. Conboy, Jr. and David P. Matthews. <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by Mr. James A. Masters, <br />307 First Interstate Bank, 112 West Jefferson Boulevard, South <br />Bend, Indiana, on behalf of the following Petitioners: <br />1. James P. Conboy, Jr. <br />Suite 331, JMS Building <br />108 North Main Street <br />South Bend, Indiana <br />2. David L. Matthews <br />205 West Jefferson <br />South Bend, Indiana <br />By James P. Conboy <br />Boulevard <br />Jr., his Attorney In -Fact <br />3. James A. Masters, as Trustee under a Trust Agreement <br />dated 7/15/88 known as Trust No. 71588 (James P. Conboy <br />Jr., and David L. Matthews, beneficial owners) <br />307 First Interstate Bank Building <br />South Bend, Indiana <br />4. Clark Information Technologies <br />6602 West Clark Drive <br />South Bend, Indiana 46628 <br />It was further noted that Mr. Masters submitted with the Petition <br />a Waiver of Notice and Consent to Vacation of Clark Drive. <br />However, Mr. Masters, as Contact Person for the Petitioners and <br />Clark Information Technologies were notified, in writing, of the <br />Board's Public Hearing date. <br />Mr. James A. Masters, 307 First Interstate Bank, 112 West <br />Jefferson Boulevard, South Bend, Indiana, was present on behalf <br />of the Petitioners and addressed the Board. Mr. Masters advised <br />that Mr. Steve Ellison, a representative of the purchaser of real <br />estate in Landmark Business Park was also present today. <br />1 <br />1 <br />1 <br />
