ME REGULAR MEETING AUGUST 22, 1988 The regular meeting of the Board of Public Works was convened at 9:34 a.m. on Monday, August 22, 1988, by Board President John E. Leszczynski, with Mr. Leszczynski, Mrs. Patricia E. DeClercq and Ms. Katherine Humphreys present. Also present was Assistant City Attorney Marva Leonard -Dent. APPROVE MINUTES OF PREVIOUS MEETING Upon a motion made by Mrs. DeClercq, seconded by Ms. Humphreys and carried, the minutes of the regular meeting of the Board held on August 15, 1988 were approved. PUBLIC HEARING AND THE DEDICATED BUT PARK Mr. Leszczynski advised Board's Public Hearing street: LE RECOMMENDATION - STREET VACATION: ED RIGHT-OF-WAY FOR A STREET NAMED BUSINESS that this was the date set for the on the proposed vacation of the following That dedicated but unimproved right-of-way for a street named "Clark Drive" as shown on the recorded plat of Landmark Business Park. The dedicated but unimproved right-of-way runs westwardly from Technology Drive approximately 435 feet to the eastern boundary line of Lot 7, Landmark Business Park, Section 1, owned by Clark Information Technologies, and is bounded on the north by a parcel to be platted as Lot 9, Landmark Business Park, owned by James P. Conboy, Jr. and David P. Matthews. It was noted that this Public Hearing is being held in order for the Board to submit a recommendation to the Common Council concerning the Vacation Petition filed by Mr. James A. Masters, 307 First Interstate Bank, 112 West Jefferson Boulevard, South Bend, Indiana, on behalf of the following Petitioners: 1. James P. Conboy, Jr. Suite 331, JMS Building 108 North Main Street South Bend, Indiana 2. David L. Matthews 205 West Jefferson South Bend, Indiana By James P. Conboy Boulevard Jr., his Attorney In -Fact 3. James A. Masters, as Trustee under a Trust Agreement dated 7/15/88 known as Trust No. 71588 (James P. Conboy Jr., and David L. Matthews, beneficial owners) 307 First Interstate Bank Building South Bend, Indiana 4. Clark Information Technologies 6602 West Clark Drive South Bend, Indiana 46628 It was further noted that Mr. Masters submitted with the Petition a Waiver of Notice and Consent to Vacation of Clark Drive. However, Mr. Masters, as Contact Person for the Petitioners and Clark Information Technologies were notified, in writing, of the Board's Public Hearing date. Mr. James A. Masters, 307 First Interstate Bank, 112 West Jefferson Boulevard, South Bend, Indiana, was present on behalf of the Petitioners and addressed the Board. Mr. Masters advised that Mr. Steve Ellison, a representative of the purchaser of real estate in Landmark Business Park was also present today. 1 1 1
