He noted that the City will be <br />paid $14,020.00 for this property. <br />It is noted that Ms. Ann Kolata, Deputy Executive Director, <br />Department of Economic Development, submitted to the Board a copy <br />of Resolution No. 899 passed by the Redevelopment Commission on <br />November 17, 1989 stating its desire to purchase City -owned <br />property at 126 Niles Avenue and appropriating $14,020.00 for the <br />purchase. Ms. Kolata therefore requested that the Board accept <br />the Commission's offer and transfer the property at the earliest <br />possible date. Mrs. DeClercq made a motion that this request be <br />approved. Mr. Leszczynski seconded the motion which carried. <br />Additionally submitted to the Board at this time was Resolution <br />No. 45-1989 of the Board authorizing the sale of real estate at <br />126 Niles Avenue and indicating the Board's desire to sell the <br />real estate to the Redevelopment Commission. Mrs. DeClercq made <br />a motion that the Resolution as submitted be adopted. Ms. <br />Humphreys seconded the motion and the following Resolution No. <br />45-1989 was adopted: <br />RESOLUTION NO. 45-1989 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, INDIANA, <br />AUTHORIZING THE SALE OF REAL ESTATE, <br />COMMONLY KNOWN AS 126 NILES AVENUE, SOUTH BEND, INDIANA, <br />TO THE SOUTH BEND REDEVELOPMENT COMMISSION <br />WHEREAS, on December 16, 1986, the Board of Public Works of <br />the City of South Bend, Indiana (hereinafter the "Board of Public <br />Works"), entered into a land contract agreement for the purchase <br />of real estate, commonly known as 126 Niles Avenue, South Bend, <br />St. Joseph County, Indiana, more particularly described as <br />follows: <br />A part of the Northeast quarter of Section 12, <br />Township 37 North, Range 2 East of the second <br />principal meridian, City of South Bend, Portage <br />Township, St. Joseph County, Indiana being Lot 92 <br />in the original plat of the Town of Lowell, and <br />described as follows: <br />Beginning at the Northwest corner of said Lot 92; <br />thence South 89° 58' 40" East, 165.69 feet, to the <br />West right-of-way of a 14 foot alley; thence South <br />00 04' 56" East, on said alley West right-of-way, <br />66 feet; thence North 890 58' 40" West, on the <br />South boundary of said Lot 92, to the East <br />right-of-way of Niles Avenue, 165.77 feet; thence <br />North 00 00' 25" West, on said East right-of-way, <br />66 feet, to the point of beginning; <br />which land contract is recorded in the Office of the St. <br />Joseph County Recorder as Document No. 8636566; and <br />WHEREAS, said land contract agreement was amended on <br />February 3, 1987, which amendment is recorded in the Office <br />of the St. Joseph County Recorder as Document No. 8706320; <br />and <br />WHEREAS, on December 1, 1989, the Board of Public Works <br />satisfied in full its obligations under said land contract <br />and amendments thereto, by payment to Mr. Christopher Davey <br />and Mr. Anthony George of $4,215.85, and thereby acquired <br />title to said real estate by way of warranty deed dated <br />December 8, 1989, which deed was recorded in the Office of <br />the St. Joseph County Recorder as Document No. 8933107; and <br />
