313 <br />REGULAR MEETING OCTOBER 16, 1989 <br />PUBLIC HEARING AND FAVORABLE RECOMMENDATION - ALL STREETS AND <br />ALLEYS SOUTH OF EWING AVENUE AND PRAIRIE AVENUE (AT THE NORTH) <br />Mr. Leszczynski advised that this was the date set for the <br />Board's Public Hearing on a proposed vacation described as <br />follows: <br />All streets and alleys south of Ewing Avenue and <br />Prairie Avenue (at the north) running south to the <br />south line of the west half of the Northeast Quarter <br />of Section 22, Township 27 North, Range 2 East, and <br />from Locust Road east to Grant Street, except 122.9 <br />feet of Irvington Street East to Locust Road and 125 <br />feet of Warren Street south of Ewing Street. Also, <br />vacating Grant Street running South from Ewing Avenue <br />to its dead-end except for the North 1661. <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by Lang, Feeney & <br />Associates, Inc., 715 South Michigan Street, South Bend, Indiana, <br />as Contact Person on behalf of Mr. Chaang Huei Luan, 54777 Luan <br />Drive, Osceola, Indiana, as the Petitioner. It was further noted <br />that pursuant to South Bend Municipal Code Section 18-53.8, <br />owners whose property abut the proposed property to be vacated as <br />well as those property owners within fifty feet (501) of the <br />property to be vacated were notified of the Board's Public <br />Hearing date. <br />Mr. Bernard Feeney, Registered Land Surveyor, Lang, Feeney & <br />Associates, Inc., 715 South Michigan Street, South Bend, Indiana, <br />was present on behalf of the Petitioner, Mr. Chaang Huei Luan, <br />doing business as B.L. Builders. Mr. Feeney apologized to the <br />Board for not being present at the Public Hearing for this <br />proposed vacation which was originally scheduled on September 5, <br />1989. <br />Mr. Feeney stated that the purpose of the Vacation Petition is tc <br />vacate all the existing streets and alleys lying to the east of <br />Boocher Subdivision. He stated that the Vacation Petition <br />includes Irvington Street east of Locust Road except through that <br />portion of property which the Petitioner does not own. The <br />petition also includes Carlisle and Phillipa Streets and the west <br />one-half (1/2) of Grant Street. Mr. Feeney advised that the <br />Petition that was re -submitted eliminates the names of the other <br />abutting property owners which were placed on the original <br />Vacation Petition. Removed was the name of Mr. Paul Szikszai, <br />2427 South Brookfield Street as well as the other property owners <br />who might be involved. <br />Mr. Feeney indicated that the Petition requests the vacation of <br />those streets that go through Mr. Luan's property. He noted that <br />the reason for the vacation is that subject to this vacation, <br />there will be a replat of those lots along Ewing Avenue. He <br />stated that a new street is planned for this area and that Mr. <br />Luan hopes to develop the property from one-half mile south and <br />from the property along Locust Road one thousand two hundred <br />(1,200) feet to the East. The development will be a single <br />family residential area with some commercial and perhaps some <br />apartments. He noted that Irvington and Warren Streets will be <br />used as primary entrances from Locust and Ewing. Mr. Feeny <br />stated that there is no plan for an entrance from the residential <br />area onto State Road 23. However, one commercial entrance/exist <br />may be provided along State Road 23 at a later date. <br />There being no one else present wishing to speak either for or <br />against the proposed vacation, and no written objections having <br />been filed with the Board, upon a motion made by Mr. Leszczynski, <br />seconded by Mrs. DeClercq and carried, the Public Hearing on this <br />matter was closed. <br />Therefore, upon a motion made by Mrs. DeClercq, seconded by Ms. <br />
