250 <br />REGULAR MEETING AUGUST 21, 1989 <br />RESOLUTION NO. 32-1989 <br />A RESOLUTION AND FINDINGS <br />OF THE SOUTH BEND BOARD OF PUBLIC WORKS <br />AUTHORIZING THE TEMPORARY OBSTRUCTION <br />OF A PORTION OF TUCKER STREET <br />IN THE CITY OF SOUTH BEND <br />WHEREAS, a portion of Tucker Street, specifically that <br />portion abutting the property of Steel Warehouse Company, Inc. at <br />2722 Tucker Street (hereinafter referred to as "Steel <br />Warehouse"), dead ends at and services only the warehousing <br />operations of Steel Warehouse; and <br />WHEREAS, said portion of Tucker Street is being used by <br />itinerant and private trash haulers as an access road to said <br />Steel Warehouse and surrounding vacant properties, for the sole <br />purpose of illegally dumping on said properties trash, rubbish <br />and debris; and <br />WHEREAS, the Board of Public Works hereby finds that these <br />circumstances present a threat to the public health and safety in <br />the form of vermin, disease and other nuisance conditions <br />resulting from said illegal dumping; and <br />WHEREAS, the Board of Public Works hereby finds that the <br />temporary obstruction of said portion of Tucker Street by means <br />of a locked fence erected, operated and maintained by Steel <br />Warehouse presents no inconvenience, loss or harm to the public, <br />due to the dead-end nature of said portion of Tucker Street, and <br />is justified as a remedy to the threat to the public health and <br />safety presented by said illegal dumping. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, AS FOLLOWS: <br />1. That the owners of Steel Warehouse are hereby authorized <br />to temporarily obstruct that portion of Tucker Street in the City <br />of South Bend abutting the Steel Warehouse property at 2722 <br />Tucker Street, by means of erecting, operating and maintaining a <br />locked fence thereon. <br />2. That the Board of Public Works shall review the situation <br />annually, determine the need for the continued obstruction of <br />said portion of Tucker Street .and act accordingly to authorize or <br />not its continued obstruction. <br />3.
