105 <br />REGULAR MEETING <br />APRIL 17, 1989 <br />sold. Mrs. Stabinik stated that that property remains a business <br />so any other business could be put in that location. <br />There being no one else present wishing to speak either for or <br />against the proposed alley vacation, Mr. Leszczynski made a <br />motion that the Public Hearing on this matter be closed. Mrs. <br />DeClercq seconded the motion and it carried. <br />Mr. Leszczynski advised that the Board has received <br />recommendations from various City departments and bureaus <br />regarding this proposed vacation. He stated that the Engineering <br />Department has recommended that additional property needs to be <br />dedicated before the alley can be vacated to accommodate <br />adequate turning radius. As there is no property available to <br />the north due to a garage at that property, it is their <br />recommendation to deny the vacation. <br />Mrs. DeClercq advised that she drove through the proposed alley <br />to be vacated last week and the comments and concerns voiced <br />today are also some of the concerns she had regarding this <br />vacation. <br />Therefore, Mrs. DeClercq made a motion that the Clerk forward to <br />the Common Council an unfavorable recommendation regarding this <br />proposed alley vacation. Ms. Humphreys stated that she is <br />familiar with the location and would concur with Mrs. DeClercq <br />that an unfavorable recommendation be sent to the Common <br />Council. She therefore seconded the motion which carried. <br />ADOPT RESOLUTION NO. 13-1989 - DISPOSAL OF SERVICE REVOLVER <br />Mr. Leszczynski stated that Police Chief Ronald G. Marciniak has <br />advised that Sergeant Arletta Vance Stickley has retired, in good <br />standing, from the South Bend Police Department, effective March <br />15, 1989 after twenty (20) years of service. In keeping with <br />Section 2-124 of the Municipal Code, Chief Marciniak requested <br />that the Board declare Sgt. Stickley's service revolver as <br />surplus property and no longer useful to the City. He stated <br />that this declaration by the Board will authorize the <br />presentation of the firearm to Sgt. Stickley as a tribute for her <br />service to the City. <br />Therefore, upon a motion made by Mrs. DeClercq, seconded by Ms. <br />Humphreys and carried, the following Resolution No. 13-1989 was <br />adopted: <br />RESOLUTION NO. 13-1989 <br />WHEREAS, I.C. 36-9-6-1 gives the Board of Public Works of <br />the City of South Bend the right and duty to have custody of, <br />control of, use of, and dispose of in accordance with Indiana <br />statutes, all real and personal property owned by the City of <br />South Bend; and <br />WHEREAS, the Common Council of the City of South Bend <br />passed as amended on January 11, 1988, Ordinance No. 7847-88, <br />which mandates the Board of Public Works of the City of South <br />Bend to determine that the service revolver of a police <br />officer who retires in good standing is surplus property and <br />no longer useful to the City of South Bend; and <br />WHEREAS, Arletta Vance Stickley has retired from the South <br />Bend Police Department after twenty (20) years of service and the <br />Board of Public Safety of the City of South Bend has determined <br />that he has retired in good standing; and <br />WHEREAS, I.C. 36-1-11-6 permits and establishes procedure <br />for disposal of personal property which is no longer needed by <br />the City and which is unfit for the purpose for which it was <br />intended; <br />
