102 <br />REGULAR MEETING <br />APRIL 17, _1�89 <br />The regular meeting of the Board of Public Works was convened at <br />9:35 a.m. on Monday, April 17, 1989, by Board President John E. <br />Leszczynski, with Mr. Leszczynski, Mrs. Patricia E. DeClercq and <br />Ms. Katherine Humphreys present. Also present was Chief Deputy <br />City Attorney Thomas Bodnar. <br />AGENDA ITEM ADDED <br />Upon a motion made by Mr. Leszczynski, seconded by Mrs. DeClercq <br />and carried, a Contractor's Bond was added to the agenda. <br />APPROVE MINUTES OF PREVIOUS MEETING <br />Upon a motion made by Mrs. DeClercq, seconded by Ms. Humphreys <br />and carried, the minutes of the regular meeting of the Board held <br />on April 10, 1989 were approved. <br />PUBLIC HEARING AND UNFAVORABLE RECOMMENDATION - ALLEY VACATION: <br />1ST E/W ALLEY SOUTH OF MISHAWAKA AVENUE RUNNING E. FROM 21ST <br />STREET <br />Mr. Leszczynski advised that this was the date set for the <br />Board's Public Hearing on a proposed alley vacation described as <br />follows: <br />The 1st East/West alley South of Mishawaka Avenue <br />Fast from 21st Street to the intersection of the 1st <br />North/South alley running from Mishawaka Avenue to <br />Vine Street, for a total distance of 133 feet more <br />or less. <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by the following <br />individuals: <br />Sheldon R. Maxey <br />921 <br />21st <br />Street <br />Bruce Metzger <br />922 <br />21st <br />Street <br />Charles Whetstone <br />925 <br />21st <br />Street <br />Lucille Quirk <br />926 <br />21st <br />Street <br />It was further noted that pursuant to South Bend Municipal Code <br />Section 18-53.8, owners whose property abut the proposed alley to <br />be vacated as well as those property owners within fifty feet <br />(501) of the proposed alley to be vacated were notified of the <br />Board's Public Hearing date. <br />Mrs. Helen Janowski, 923 South Ironwood, South Bend, Indiana, was <br />present and advised the Board that she has lived at 923 South <br />Ironwood for seventeen (17) years and operates a daycare from her <br />residence. She submitted to the Board a letter signed by five <br />(5) individuals that utilize her daycare facility which indicated <br />that the vacating of the east/west alley would cause a dangerous <br />problem for the people for which daycare services are provided. <br />Mrs. Janowski also submitted a letter from Third District <br />Councilman William Soderberg advising that he has reviewed the <br />proposed alley to be vacated and asked that the Board consider <br />this location thoroughly. Mrs. Janowski also submitted a letter <br />with the signatures of her daughter, Judy Stabinik, 16555 Gerald <br />Street, Granger, Indiana, and her son Mr. Joseph Janowski, Jr., <br />28488 Pine Lake, Edwardsburg, Michigan, stating that they have <br />difficulty parking on Ironwood because of all the businesses and <br />it would be dangerous for them to back out onto Ironwood Drive as <br />there is no room to turn into the north/south alley. <br />Mr. Joseph Janowski, 923 South Ironwood, South Bend, Indiana, <br />addressed the Board and stated that he doesn't want the alley <br />vacated because it would be dangerous to back out onto Ironwood <br />Drive as there is a lot of heavy traffic on Ironwood. <br />1 <br />C <br />1 <br />
