419 <br />REGULAR MEETING DECEMBER 26, 1990 <br />All of the Easements are to allow telephone wires to connect thee <br />various buildings that comprise Memorial's campus and all expire <br />on December 31, 1993. Mr. Leszczynski made a motion that the <br />Easements be approved. Ms. Humphreys seconded the motion which <br />carried. <br />APPROVE AGREEMENT FOR ENGINEERING SERVICES IN CONNECTION WITH <br />SOUTH BEND RESOURCE RECOVERY STUDY <br />Mr. Leszczynski advised that the City believes in and is <br />committed to the conservation of its natural resources and <br />preservation of the environment. Through a program that has <br />optimum reuse of materials through development of recycling <br />markets the City can best achieve its goals. <br />Therefore, Mr. Leszczynski requested that the Board approve an <br />Agreement for Engineering Services In Connection With South Bend <br />Resource Recovery Study as submitted by Tenney Pavoni Associates, <br />Inc., to do an analysis of the solid waste collection system and <br />means of revamping the system including possible recycling, <br />composting, etc. Mr. Leszczynski noted that the term of the <br />Agreement is six (6) months with total compensation not to exceed <br />$50,000.00. Ms. Humphreys made a motion that the Agreement be <br />approved. Mr. Leszczynski seconded the motion which carried. <br />APPROVE AGREEMENTS - PHASE I AND II - OLD CLEVELAND ROAD <br />REALIGNMENT <br />Mr. Leszczynski advised that as part of the Airport 2010 Project, <br />the Board of Public Works, as agent and on behalf of the <br />Department of Economic Development, is in receipt of a Standard <br />Form of Agreement between Owner and Engineer for Professional <br />Services as submitted by Cole Associates, Inc., 2211 East <br />Jefferson Boulevard, South Bend, Indiana, which indicates that <br />Cole will prepare plans, specifications and right-of-way drawings <br />and related items necessary for the purchase of rights -of -way and <br />the construction of relocated Old Cleveland Road from the U.S. 31 <br />South Bend Bypass to Mayflower Road. The cost for these <br />engineering services is $144,650.00. For the record, Mr. <br />Leszczynski noted that Section 7.6 of the Agreement entitled <br />Arbitration should be stricken from the Agreement. <br />Additionally, the Board is in receipt of an Agreement for <br />Professional Services as submitted by Ken Herceg & Associates, <br />Inc., for engineering services for design of Old Cleveland Road <br />realignment from Mayflower Road east to Old Cleveland Road, west <br />of Bendix Drive. This Agreement, in an amount not to exceed <br />$149,860.00 is for Phase II of this Project. <br />Therefore, Ms. Humphreys made a motion that the Agreements as <br />submitted be approved and executed subject to Section 7.6 <br />Arbitration Clause of the Agreement submitted by Cole Associates <br />being stricken. Mr. Leszczynski seconded the motion which <br />carried. <br />ACCEPT AND APPROVE SUBSTANTIAL COMPLETION CERTIFICATES - <br />WASTEWATER TREATMENT PLANT IMPROVEMENTS PROJECT <br />Mr. Karl Kopec, Operations Manager, Environmental Services, <br />submitted to the Board three (3) Substantial Completion <br />Certificates for the approval of the Bar Screen Building, the <br />Reuse Water Building and Aeration Tank No. 1. Mr. Kopec <br />requested that the Board approve these Certificates as <br />submitted. Mr. Leszczynski made a motion that the Certificates <br />be accepted and approved. Ms. Humphreys seconded the motion <br />which carried. <br />
