lair! <br />SPECIAL MEETING <br />APRIL 24, 1990 <br />A Special meeting of the Board of Public Works was convened at <br />9:37 a.m. on Tuesday, April 24, 1990, by Board member Patricia E. <br />DeClercq, with Mrs. DeClercq and Ms. Katherine Humphreys present. <br />Board President John E. Leszczynski was not in attendance. <br />PUBLIC HEARING - TRANSFER OF REAL ESTATE AND ADOPTION OF <br />RESOLUTION NO. 13-1990 INDICATING INTENTION TO TRANSFER CERTAIN <br />REAL ESTATE TO SOUTH BEND REDEVELOPMENT AUTHORITY <br />Mrs. DeClercq advised that this was the date set for the Board's <br />Public Hearing regarding the transfer of certain real estate to <br />the Redevelopment Authority. The Clerk tendered proofs of <br />publication of Notice of Public Hearing which appeared in the <br />South Bend Tribune and the Tri-County News which were found to be <br />sufficient. <br />Mrs. DeClercq noted that the Board of Public Works has been <br />designated by the Mayor as the entity responsible for holding a <br />Public Hearing on the transfer of property to the South Bend <br />Redevelopment Authority in order for the Authority to make <br />certain improvements. It is further noted that the property to <br />be transferred is as follows: <br />Central Business District curbs and sidewalks in front of: <br />- 100 block of West Washington Street; <br />- The southeast corner of Lafayette Boulevard and Jefferson <br />Boulevard. <br />Ms. Ann Kolata, Deputy Executive Director, Department of Economic <br />Development, was present and asked for the Board's favorable <br />consideration of this transfer. She stated that this transfer <br />includes property that was not included in the transfer of <br />property that took place on February 26, 1990 and therefore this <br />transfer is a follow-up to that previous action. She noted that <br />the sidewalks and curbs are located in front of the Trigon <br />Building on West Jefferson and Lafayette and in front of the <br />former Business Systems building on Washington. <br />There being no one else present wishing to address the Board <br />concerning this matter, upon a motion made by Mrs. DeClercq, <br />seconded by Ms. Humphreys and carried, the Public Hearing was <br />closed. <br />Accordingly, Mrs. DeClercq advised that the appropriate <br />Resolution transferring said property has been prepared and is <br />being submitted at this time for adoption. Ms. Humphreys made a <br />motion that the Resolution as submitted be adopted. Mrs. <br />DeClercq seconded the motion which carried and the following <br />Resolution No. 13-1990 was adopted: <br />RESOLUTION NO. 13-1990 <br />A RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC <br />WORKS INDICATING ITS INTENTION TO TRANSFER CERTAIN <br />REAL ESTATE TO THE SOUTH BEND REDEVELOPMENT AUTHORITY <br />WHEREAS, pursuant to I.C. 36-9-6-3 the South Bend Board of <br />Public Works has custody of all real and personal property of the <br />City; and, <br />WHEREAS, pursuant to I.C. 36-9-6-6 the Board of Public Works is <br />authorized to repair public ways, sidewalks or public places <br />within the City; and, <br />WHEREAS, those portions of public right of way described in <br />Exhibit A, attached hereto and made a part hereof, all of which <br />
