Sekan, Area Manager, Non - <br />Collusion Affidavit was in order and a five per cent (50) <br />Bid Bond was submitted. <br />BID: $536,129.55 <br />Mr. Leszczynski made a motion that the above bids for the various <br />projects be referred to the Engineering Department and the <br />Department of Economic Development for review and recommendation <br />and that the Non -Discrimination Commitment forms as submitted <br />with the bids be accepted for filing. Ms. Humphreys seconded the <br />motion which carried. <br />AWARD BID - ATOMIC ABSORPTION/EMISSION SPECTROMETER <br />Mr. Leszczynski advised that Mr. Jack Dillon and Mr. Tim Brill of <br />the Division of Environmental Services have reviewed the two (2) <br />bids received on February 12, 1990 for the above referred to <br />equipment and recommend at this time that the Board award the bid <br />of Perkin-Elmer Corporation, 9855 Crosspoint Blvd., Suite 140, <br />Indianapolis, Indiana, in the amount of $42,290.00 for the above <br />referred to equipment. <br />Mr. Leszczynski noted that the bid submitted by Varian <br />Associates, Inc., Instrument Group, 505 Julie Rivers Road, Suite <br />150, Sugar Land, Texas, in the amount of $37,457.00, was not <br />selected as the bid was not in compliance with bid specifications <br />in the following areas: <br />- Burner system which accommodates and includes flow <br />spoiler and ceramic impact bead <br />- Graphite furnace with separate internal and external <br />gas flows <br />- Pneumatically opened furnace <br />- Optical temperature sensor <br />- Tri-Metal composite optical base <br />Mr. Michael Lang, representing Varian Associates, was present and <br />disputed the statement made that the Varian bid did not comply <br />with bid specifications and indicated that the instrument bid by <br />Varian was in compliance. <br />Board Attorney Jenny Pitts Manier advised members of the Board <br />that they have yet to vote to award the bid based on information <br />received which also indicated that the bid of Varian did not meet <br />specifications. She stated that the Board has two (2) options to <br />either accept the recommendation and award the bid or to table <br />the award of the bid. She noted that since the Board has been <br />presented with a recommendation there appears to be no reason not <br />to take action. Should the Board award to Perkin-Elmer, Varian <br />will be notified and they will have whatever right the law <br />affords them in this issue. <br />Mr. Leszczynski advised Mr. Lang that the Board has received a <br />recommendation and has the information which he supplied with his <br />bid. Therefore, the Board at this time is in a position to act <br />on the recommendation and award the bid of Perkin-Elmer and that <br />Mr. Lang may proceed with any legal recourse available to him in <br />this matter. <br />1 <br />1 <br />1 <br />
