REGULAR MEETING <br />FEBRUARY 26, 1990 <br />1 <br />1 <br />The regular meeting of the Board of Public Works was convened at <br />9:33 a.m. on Monday, February 26, 1990, by Board President John <br />E. Leszczynski, with Mr. Leszczynski, Mrs. Patricia E. DeClercq <br />and Ms. Katherine Humphreys present. Also present was Assistant <br />City Attorney Jenny Pitts Manier. <br />APPROVE MINUTES OF PREVIOUS MEETING <br />Upon a motion made by Mrs. DeClercq, seconded by Mr. Leszczynski <br />and carried, the minutes of the February 19, 1990, regular <br />meeting of the Board were approved. <br />PUBLIC HEARING - TRANSFER OF REAL ESTATE AND ADOPTION OF <br />RESOLUTION NO. 4-1990 INDICATING INTENTION TO TRANSFER CERTAIN <br />REAL ESTATE TO SOUTH BEND REDEVELOPMENT AUTHORITY <br />Mr. Leszczynski advised that this was the date set for the <br />Board's Public Hearing concerning the transfer of certain City <br />owned property to the Redevelopment Authority. It is noted that <br />state law requires that before the City can transfer property <br />which it owns, a Public Hearing must be held to determine the <br />advisability of the transfer. The Mayor has designated the Board <br />as the entity to hold the Public Hearing on the advisability of <br />transferring certain City -owned property to the Redevelopment <br />Authority so that the Authority can make improvements with the <br />proceeds derived from the 1990 Tax Incremental Financing Bonds. <br />Mr. Larry Koepfle, Department of Economic Development, addressed <br />the Board and advised that for the record he would like to <br />request that the Board transfer the referred to property to the <br />Redevelopment Authority in order that they may proceed with the <br />tax incremental financing bond issue. He advised that it is <br />necessary that the property be in the name of the Redevelopment <br />Authority during the term of the bonds. Mr. Koepfle indicated <br />that the public right-of-ways being transferred include Niles <br />Avenue between LaSalle and Washington, Madison, from Niles to the <br />East Race, Washington from Niles to Hill and approximately <br />fourteen (14) curbs and sidewalks in the Central Business <br />District. <br />There being no one else present wishing to speak either for or <br />against the proposed transfer, and no written objections having <br />been filed with the Board, Mr. Leszczynski made a motion that the <br />Public Hearing be closed. Mrs. DeClercq seconded the motion <br />which carried. <br />Accordingly, Mr. Leszczynski advised that Resolution No. 4-1990 <br />indicating the City's intention to transfer certain real estate <br />to the South Bend Redevelopment Authority has been prepared and <br />submitted to the Board for adoption. Mrs. DeClercq made a motion <br />that the Resolution be adopted. Ms. Humphreys seconded the <br />motion which carried and the following Resolution No. 4-1990 was <br />adopted: <br />RESOLUTION NO. 4-1990 <br />A RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC <br />WORKS INDICATING ITS INTENTION TO TRANSFER CERTAIN <br />REAL ESTATE TO THE SOUTH BEND REDEVELOPMENT AUTHORITY <br />WHEREAS, pursuant to I.C. 36-9-6-3 the South Bend Board of <br />Public Works has custody of all real and personal property of the <br />City; and, <br />WHEREAS, pursuant to I.C. 36-9-6-6 the Board of Public Works <br />is authorized to repair public ways, sidewalks or public places <br />within the City; and, <br />
