REGULAR MEETING FEBRUARY 26, 1990 1 1 The regular meeting of the Board of Public Works was convened at 9:33 a.m. on Monday, February 26, 1990, by Board President John E. Leszczynski, with Mr. Leszczynski, Mrs. Patricia E. DeClercq and Ms. Katherine Humphreys present. Also present was Assistant City Attorney Jenny Pitts Manier. APPROVE MINUTES OF PREVIOUS MEETING Upon a motion made by Mrs. DeClercq, seconded by Mr. Leszczynski and carried, the minutes of the February 19, 1990, regular meeting of the Board were approved. PUBLIC HEARING - TRANSFER OF REAL ESTATE AND ADOPTION OF RESOLUTION NO. 4-1990 INDICATING INTENTION TO TRANSFER CERTAIN REAL ESTATE TO SOUTH BEND REDEVELOPMENT AUTHORITY Mr. Leszczynski advised that this was the date set for the Board's Public Hearing concerning the transfer of certain City owned property to the Redevelopment Authority. It is noted that state law requires that before the City can transfer property which it owns, a Public Hearing must be held to determine the advisability of the transfer. The Mayor has designated the Board as the entity to hold the Public Hearing on the advisability of transferring certain City -owned property to the Redevelopment Authority so that the Authority can make improvements with the proceeds derived from the 1990 Tax Incremental Financing Bonds. Mr. Larry Koepfle, Department of Economic Development, addressed the Board and advised that for the record he would like to request that the Board transfer the referred to property to the Redevelopment Authority in order that they may proceed with the tax incremental financing bond issue. He advised that it is necessary that the property be in the name of the Redevelopment Authority during the term of the bonds. Mr. Koepfle indicated that the public right-of-ways being transferred include Niles Avenue between LaSalle and Washington, Madison, from Niles to the East Race, Washington from Niles to Hill and approximately fourteen (14) curbs and sidewalks in the Central Business District. There being no one else present wishing to speak either for or against the proposed transfer, and no written objections having been filed with the Board, Mr. Leszczynski made a motion that the Public Hearing be closed. Mrs. DeClercq seconded the motion which carried. Accordingly, Mr. Leszczynski advised that Resolution No. 4-1990 indicating the City's intention to transfer certain real estate to the South Bend Redevelopment Authority has been prepared and submitted to the Board for adoption. Mrs. DeClercq made a motion that the Resolution be adopted. Ms. Humphreys seconded the motion which carried and the following Resolution No. 4-1990 was adopted: RESOLUTION NO. 4-1990 A RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC WORKS INDICATING ITS INTENTION TO TRANSFER CERTAIN REAL ESTATE TO THE SOUTH BEND REDEVELOPMENT AUTHORITY WHEREAS, pursuant to I.C. 36-9-6-3 the South Bend Board of Public Works has custody of all real and personal property of the City; and, WHEREAS, pursuant to I.C. 36-9-6-6 the Board of Public Works is authorized to repair public ways, sidewalks or public places within the City; and,
