REGULAR MEETING <br />NOVEMBER 18, 1_991 <br />Commitment form was completed and a five per cent (5%) Bid <br />Bond was submitted. <br />BID: $35,400.00 <br />Upon a motion made by Mr. Leszczynski, seconded by Mrs. DeClercq <br />and carried, the above bids were referred to the Engineering <br />Department for review and recommendation. <br />PUBLIC HEARING AND FAVORABLE RECOMMENDATION - 1ST E/W ALLEY N. OF <br />CEDAR STREET, RUNNING E. FROM ST. PETER STREET TO NOTRE DAME <br />AVENUE AND ST. PETER STREET FROM MINER STREET TO CEDAR STREET <br />Mr. Leszczynski advised that this was the date set for the <br />Board's Public Hearing on a proposed alley and street vacation as <br />follows: <br />The 1st east/west alley north of Cedar Street, running <br />east from St. Peter Street, for a distance of approximately <br />345 feet to Notre Dame Avenue, all in Chapoton Place <br />Subdivision of Cottrell's Addition to Lowell, and St. Peter <br />Street, from Miner Street running South to Cedar Street for a <br />distance of approximately 322 feet. <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by Attorney John B. Ford, <br />P.O. Box 4577, South Bend, Indiana, on behalf of Saint Joseph's <br />Medical Center, Inc., 801 East LaSalle Street, P.O. Box 1935, <br />South Bend, Indiana. <br />It was further noted that pursuant to South Bend Municipal Code <br />Section 18-53.8, owners whose property abut the proposed alley <br />and street to be vacated as well as those property owners within <br />one hundred fifty feet (1501) of the alley and street to be <br />vacated were notified of the Board's Public Hearing date. <br />Mr. John Ford, Attorney at Law, 1800 Valley American Bank <br />Building, South Bend, Indiana, was present on behalf of the <br />Petitioner, Saint Joseph's Medical Center, Inc. <br />Mr. Ford submitted to the Board a reduced site plan of <br />construction proposed by St. Joseph Medical Center as well as a <br />map of the proposed vacation and indicated that the vacation is <br />needed for the construction of a new medical pavilion. Mr. Ford <br />noted that the Board will recall that the Medical Center <br />previously submitted a vacation petition which was subsequently <br />withdrawn as the plans for the construction of the new medical <br />office building were revised and the location was changed. <br />Mr. Ford informed the Board that the Medical Center owns Lot Nos. <br />11-20, 1-10 and 16-17. He noted that houses currently located on <br />some of the lots will be torn down immediately. Then, based on <br />approval of the vacation, construction of the new office building <br />will begin. <br />It is noted that the ordinance submitted with the Vacation <br />Petition indicates that the purpose of this vacation is to <br />increase and improve parking areas and private drives serving the <br />Medical Center including the hospital and medical office <br />buildings. <br />There being no one else present wishing to speak either for or <br />against the proposed vacation, and no written objections having <br />been filed with the Board, upon a motion made by Mr. Leszczynski, <br />seconded by Mrs. DeClercq and carried, the Public Hearing on this <br />matter was closed. <br />There being no comments or questions by members of the Board, Ms. <br />Humphreys made a motion that a favorable recommendation <br />concerning this Vacation Petition be forwarded to the Common <br />Council. Mrs. DeClercq seconded the motion which carried. <br />
