REGULAR MEETING <br />OCTOBER 21, 1991 <br />Mr. Leszczynski made a motion that the bids be referred to <br />Century Center for review and recommendation. Ms. Humphreys <br />seconded the motion which carried. <br />PUBLIC HEARING CONTINUED - VACATION OF CEDAR STREET, BETWEEN <br />NOTRE DAME AVENUE AND ST. LOUIS BOULEVARD AND A PORTION OF ST. <br />PETER STREET BETWEEN MINER STREET AND CEDAR STREET <br />Mr. Leszczynski advised that this was the date set for the <br />Board's Public Hearing on the proposed vacation of the following <br />streets: <br />Cedar Street between Notre Dame Avenue and St. Louis <br />Boulevard and a portion of St. Peter Street between <br />Miner Street and Cedar Street in South Bend, Indiana <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by Mr. William T. <br />Hambling, Saint Joseph's Medical Center, Inc., 801 East LaSalle <br />Street, P.O. Box 1935, South Bend, Indiana. It was further <br />noted that pursuant to South Bend Municipal Code Section 18-53.8, <br />owners whose property abut the proposed streets to be vacated as <br />well as property owners within one hundred fifty (150) feet of <br />the streets to be vacated were notified of the Board's Public <br />Hearing date. <br />Members of the Board noted that a news article appeared in the <br />South Bend Tribune on Sunday, October 20, 1991, which indicated <br />that the hospital would be withdrawing their request to close the <br />above referenced streets. However, as the Board did not receive <br />any written notification of such, and as the Petitioner was not <br />present at the meeting, Mrs. DeClercq made a motion that the <br />Public Hearing on this matter be continued until the Board <br />receives notification of the intent of the Petitioner. Ms. <br />Humphreys seconded the motion which carried. <br />A gentleman who was present for the Public Hearing advised the <br />Board that there appears to be a traffic problem at the <br />intersection of Cedar and St. Peter Street and suggested the <br />installation of a three (3) or four (4) way stop sign. Mr. <br />Leszczynski indicated that the City would look into this matter. <br />ADOPT RESOLUTION NO. 41-1991 - APPROVING A( <br />PRESERVATION OF WARRANTIES CON <br />AGREEMENT DATED JULY 15, 1991 <br />ED IN THE USARC EXCHANGE <br />Board Attorney Mary H. Mueller advised that the Resolution <br />submitted today indicates the approving of a Deed to USARC as <br />well as containing certain warranties and environmental <br />guarantees. <br />Therefore, upon a motion made by Mrs. DeClercq, seconded by <br />Mr. Leszczynski and carried, the following Resolution No. 41-1991 <br />was adopted: <br />RESOLUTION NO. 41-1991 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, INDIANA <br />APPROVING ACTIONS TO INSURE THE PRESERVATION <br />OF WARRANTIES CONTAINED IN THE USARC <br />EXCHANGE AGREEMENT, DATED JULY 15, 1991 <br />WHEREAS, on July 15, 1991, the City of South Bend, Indiana, <br />subsequent to prior authorization of the South Bend Common <br />Council, and pursuant to Indiana law, adopted Resolution 30-1991, <br />approving the transfer of certain real property described therein <br />and commonly referred to as the former Maple Lane School <br />property, to the Civic Foundation of St. Joseph County, Inc., and <br />
