REGULAR MEETING JULY 15, 1991
<br />WHEREAS, in its resolution dated November 20, 1989, the Board
<br />of Park Commissioners declared and found it to be in the best
<br />interest of the City and the City's Park Department to transfer
<br />title to the Northside Boulevard Armory so as to facilitate the
<br />relocation of the Army Reserve Corps housed there and to
<br />facilitate the acquisition of Northside by Indiana University for
<br />the expansion of its South Bend campus, the Northside Boulevard
<br />Armory no longer being used, and use of it not being
<br />contemplated, for park purposes; and
<br />WHEREAS, by Ordinance No. 8188-91, the Common Council of the
<br />City of South Bend approved the transfer of the Northside
<br />Boulevard Armory to the City of South Bend, Indiana, and approved
<br />and directed the subsequent transfer of the Northside Boulevard
<br />Armory by the City of South Bend to the Foundation, pursuant to
<br />I.C. 36-1-11-1( )( ); and
<br />WHEREAS, pursuant to I.C. 36-1-11-8, the Board of Park
<br />Commissioners of the City of South Bend by resolution adopted
<br />June 17, 1991, and the City of South Bend, acting by and through
<br />its Board of Public Works, by Resolution No. 25-1991, adopted on
<br />June 24, 1991, approved and accepted, respectively, the transfer
<br />of the Northside Boulevard Armory from the Park Department to the
<br />City of South Bend, and assigned and accepted assignment of,
<br />respectively, the Land Lease to the City of South Bend; and
<br />WHEREAS, the deed transferring the Northside Boulevard Armory
<br />from the Park Department to the City of South Bend was executed
<br />by, and the Land Lease assigned to, the City of South Bend
<br />effective July 5, 1991; and
<br />WHEREAS, the City of South Bend and the Foundation are
<br />desirous of memorializing the terms governing the purchase and
<br />sale of the Northside Boulevard Armory by the City of South Bend
<br />to the Foundation, which terms are memorialized in the Purchase
<br />Agreement attached hereto.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS
<br />OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS:
<br />1. The transfer of the following described property,
<br />situated in St. Joseph County, Indiana, by the City of South
<br />Bend, Indiana, to the Community Foundation of St. Joseph County,
<br />Inc., (formerly the Civic Foundation):
<br />A part of the West Half (WI) of the Northeast
<br />Quarter (NEI) of Section Eighteen (18), Township
<br />Thirty Seven (37) North, Range Three (3) East,
<br />Portage Township, all in the City of South Bend,
<br />St. Joseph County, Indiana, and more particularly
<br />described as follows:
<br />Beginning at the southeast corner of Lot No. 24 in
<br />Miksell's G.W. First Addition in South Bend,
<br />Indiana (Plat Book No. 8, Page 137, St. Joseph
<br />County), said corner being on the southerly
<br />extension of the west right of way line of a
<br />public street (now known as Greenlawn Avenue);
<br />thence North 89034155" West (Assumed Bearing)
<br />along the south line of said Lot No. 24 a distance
<br />of 141.85 feet; thence along the south line of a
<br />14 foot alley South 78053►00" West a distance of
<br />364.59 feet; thence South 00020125" East a
<br />distance of 370.19 feet; thence South 62012125"
<br />East a distance of 177.06 feet to the northern
<br />right of way line of a public street (now known as
<br />Northside Boulevard); thence continuing along said
