4.32 REGULAR MEETING DECEMBER 21, 1992 WARNER AND SONS, INC. P.O. Box 87 Elkhart, Indiana 46515 Quotation was signed by Mr. John Bamber, Project Estimator. QUOTATION: $24,934.00 Upon a motion made by Mr. Leszczynski, seconded by Mrs. Mueller and carried, the above Quotations were referred to the Division of Engineering for review and recommendation. ADOPT RESOLUTIONS: - NO. 48-1992 - ACCEPTING THE TRANSFER OF REAL PROPERTY FROM THE SOUTH BEND REDEVELOPMENT COMMISSION AND - NO. 49-1992 - TRANSFER OF REAL PROPERTY TO REAL SERVICES, INC. Ms. Ann Kolata, Director of Redevelopment was present and advised that Resolution No. 48-1992 conveys to the City a parcel of property from the Redevelopment Commission. Resolution No. 49-1992 conveys this same parcel to Real Services, Inc., who will utilize this parcel along with three (3) others for the construction of a new facility. It was noted that the City may transfer property to a nonprofit corporation in this fashion. Therefore, Mr. Caldwell made a motion that the Resolutions as prepared be adopted. Ms. Mueller seconded the motion which carried and the following Resolution Nos. 48-1992 and 49-1992 were adopted: RESOLUTION 48-1992 .A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA ACCEPTING THE TRANSFER OF REAL PROPERTY FROM THE SOUTH BEND REDEVELOPMENT COMMISSION WHEREAS, the City of South Bend, Department of Redevelopment has appropriated and condemned the following -described real property situated in St. Joseph County, Indiana:: A lot or parcel of land in the West Half (1/2) of the Northwest Quarter (1/4) of Section No. Thirteen (13), Township No. Thirty-seven (37) North, Range No. Two (2) East, described as follows, viz: Beginning on the West line of South Michigan Street, in the City of South Bend, at the Southeast corner of the Plat of South Bend City, as platted by Samuel Morrison, now within and a part of the City of South Bend; thence running South on the West line of Michigan Street, 35 feet; thence West 10 rods, more or less, to the East line of a public alley; thence North on the East line of said alley, 35 feet; thence East 10 rods, more or less, to the place of beginning, and now known as Lot Lettered A as shown on the recorded Plat of Stull's Third Addition to the City of South Bend. Key No. 18-8004-0192, ("Real Property"); and WHEREAS, pursuant to I.C. 36-7-14-3 the South Bend Redevelopment Commission ("Commission") is the governing body of the City of South Bend Department of Redevelopment and, pursuant to I.C. 36-7-14-12.2 is authorized to diispose of the Real Property; and WHEREAS, the Commission, in Resolution 1120, adopted on December 18, 1992, expressed its desire to convey its interest in the Real Property to the City of South Bend, Indiana; and 1 1
