REGULAR MEETING DECEMBER 7, 1992 1 1 1 1 ADOPT RESOLUTION NO. 46-1992 CHANGING THE NAME OF PEBBLE CREEK DRIVE TO PEBBLE CREEK COURT It was noted that on October 19, 1992, the Board received a request from Mr. Grama K. Bhagavan, President, Valley Engineering Consultants, Inc., 14887 State Road 23, Granger, Indiana, requesting that the City change the street name of Pebble Creek Drive to Pebble Creek Court as listed on the preliminary plat. Mr. Bhagavan stated that the subdivision final plat was recorded with the name Pebble Creek Drive and after the subdivision was recorded, the scrivener error, where the street name was inadvertently drafted as Drive instead of Court was discovered on the plat. Therefore, submitted to the Board at this time is the appropriate Resolution correcting this error. Mr. Caldwell made a motion that the Resolution be adopted. Mrs. Mueller seconded the motion which carried and the following Resolution No. 46-1992 was adopted: RESOLUTION NO. 46-1992 A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, CHANGING THE NAME OF PEBBLE CREEK DRIVE TO PEBBLE CREEK COURT WHEREAS, Section 18-2 of the South Bend Municipal Code gives the Board of Public Works "control and supervision of the streets within the city;" and WHEREAS, Pebble Creek Drive is located within the Cross Creek Subdivision, Section 5, as shown on attached Exhibit A, and is a part of the City of South Bend; and WHEREAS, the street in question is a cul-de-sac and should have been designated as a "Court" instead of a "Drive", but by scrivener's error, the street name was inadvertently drafted on the final plat as a drive; and WHEREAS, the street in question is not yet constructed, the land abutting the street is still owned by the developer, and the agent of the developer, Grama K. Bhagavan, has asked the Board of Public Works to change the street name from Pebble Creek Drive to Pebble Creek Court, as set out in the attached request marked as Exhibit B; and WHEREAS, the change of name requested will not adversely affect the health, safety or welfare of the citizens of the City of South Bend. NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South Bend that the name of Pebble Creek Drive be changed to Pebble Creek Court effective immediately.
