REGULAR MEETING JULY 6, 1992 asked if it was because they did not use all the funds allotted. Ms. Townsend indicated that the LaSalle Park District Council did complete their activity under this Contract and has now decided to take part in food distribution activities as a new activity under the Contract. ADOPT RESOLUTION NO. 24-1992 - PURCHASE OF REAL ESTATE NECESSARY FOR THE BOWMAN CREEK DRAINAGE PROJECT Board Attorney and Member Mary H. Mueller advised that the Resolution which has been prepared and submitted to the Board today for consideration provides for the purchase of property at 114 East Fox Street which is the only parcel which the City needs to purchase in conjunction with the Bowman Creek Drainage Project. Mrs. Mueller noted that the value of the property is $6,000.00 and the Resolution indicates that the Board finds that the purchase of this property is necessary to the project, that the property is worth $6,000.00 and authorizes the attorney to make an offer to the property owner in that amount. Therefore, Mr. Caldwell made a motion that the Resolution as submitted be adopted. Mrs. Mueller seconded the motion which carried and the following Resolution No. 24-1992 was adopted: RESOLUTION NO. 24-1992 A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND APPROVING FOR THE BOWMAN CREEK DRAINAGE PROJECT WHEREAS, the Board of Public Works of the City of South Bend (Board) is authorized by I.C. 36-9-6-4 to purchase real estate needed for public works projects; and WHEREAS, the Board has recently approved plans and authorized advertisement for the receipt of bids for the Bowman Creek Drainage Project (Project); and WHEREAS, the Project will provide for increased flow capacity for Bowman Creek, which will diminish flooding that has damaged public and private property in the past years; and WHEREAS, the Project requires the purchase of property located at 114 East Fox Street, also described as Lot 267 of Bowman's 6th Addition to the City of South Bend, for the installation and maintenance of a trash rack and inlet structure for a subterranean pipeline that is a part of Bowman Creek; and WHEREAS, the value of the property at 114 East Fox Street has been appraised at $4,000.00, and the owner of the property has made improvements to the property in the amount of $2,000.00 since the appraisal. NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South Bend as follows: 1) The acquisition of the -property located at 114 East Fox Street, also described as Lot 267 of Bowman's 6th Addition to the City of South Bend, Indiana, is found to be in the best interest of the City and necessary for the construction of the Bowman Creek Drainage Project. 2) The current fair market value of said property is $6,000.00. 3) The attorney for the Board is hereby authorized to cause an offer to purchase to be made in writing to the owner of said property in the amount of $6,000.00.
