REGULAR MEETING <br />JULY 6, 1992 <br />asked if it was because they did not use all the funds allotted. <br />Ms. Townsend indicated that the LaSalle Park District Council did <br />complete their activity under this Contract and has now decided <br />to take part in food distribution activities as a new activity <br />under the Contract. <br />ADOPT RESOLUTION NO. 24-1992 - PURCHASE OF REAL ESTATE NECESSARY <br />FOR THE BOWMAN CREEK DRAINAGE PROJECT <br />Board Attorney and Member Mary H. Mueller advised that the <br />Resolution which has been prepared and submitted to the Board <br />today for consideration provides for the purchase of property at <br />114 East Fox Street which is the only parcel which the City needs <br />to purchase in conjunction with the Bowman Creek Drainage <br />Project. Mrs. Mueller noted that the value of the property is <br />$6,000.00 and the Resolution indicates that the Board finds that <br />the purchase of this property is necessary to the project, that <br />the property is worth $6,000.00 and authorizes the attorney to <br />make an offer to the property owner in that amount. <br />Therefore, Mr. Caldwell made a motion that the Resolution as <br />submitted be adopted. Mrs. Mueller seconded the motion which <br />carried and the following Resolution No. 24-1992 was adopted: <br />RESOLUTION NO. 24-1992 <br />A RESOLUTION OF THE BOARD OF PUBLIC <br />WORKS OF THE CITY OF SOUTH BEND APPROVING <br />FOR THE BOWMAN CREEK DRAINAGE PROJECT <br />WHEREAS, the Board of Public Works of the City of South Bend <br />(Board) is authorized by I.C. 36-9-6-4 to purchase real estate <br />needed for public works projects; and <br />WHEREAS, the Board has recently approved plans and <br />authorized advertisement for the receipt of bids for the Bowman <br />Creek Drainage Project (Project); and <br />WHEREAS, the Project will provide for increased flow <br />capacity for Bowman Creek, which will diminish flooding that has <br />damaged public and private property in the past years; and <br />WHEREAS, the Project requires the purchase of property <br />located at 114 East Fox Street, also described as Lot 267 of <br />Bowman's 6th Addition to the City of South Bend, for the <br />installation and maintenance of a trash rack and inlet structure <br />for a subterranean pipeline that is a part of Bowman Creek; and <br />WHEREAS, the value of the property at 114 East Fox Street <br />has been appraised at $4,000.00, and the owner of the property <br />has made improvements to the property in the amount of $2,000.00 <br />since the appraisal. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works <br />of the City of South Bend as follows: <br />1) The acquisition of the -property located at 114 East Fox <br />Street, also described as Lot 267 of Bowman's 6th <br />Addition to the City of South Bend, Indiana, is found to <br />be in the best interest of the City and necessary for the <br />construction of the Bowman Creek Drainage Project. <br />2) The current fair market value of said property is <br />$6,000.00. <br />3) The attorney for the Board is hereby authorized to cause <br />an offer to purchase to be made in writing to the owner <br />of said property in the amount of $6,000.00. <br />
