McIntyre, Chairman Of The <br />Board, Non -Collusion Affidavit was in order, Non - <br />Discrimination Commitment form was completed and a five <br />per cent (5%) Bid Bond was submitted. <br />BID: $76,125.00 <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Caldwell <br />and carried, the above bid was referred to the Engineering <br />Department for review and recommendation. <br />FAVORABLE RECOMMENDATION - VACATION OF EAST SORIN STREET/NEDDO <br />COURT <br />Mr. Leszczynski advised that submitted to the Board is the second <br />amended Vacation Petition as filed by Mr. C. Brian Sauers, Esq., <br />Barnes & Thornburg, 600 1st Source Bank Center, 100 North <br />Michigan Street, South Bend, Indiana, on behalf of Madison <br />Center, Inc., 403 East Madison, South Bend, Indiana, and Bert and <br />Etta Liss Trust, Society Bank, Co -Trustee, to vacate the <br />following property: <br />East Sorin Street, from the west right-of-way line of <br />North Niles Avenue, running West to the St. Joseph River, <br />for a distance of approximately 330 feet; Neddo Court, <br />from the north right-of-way line of East Sorin Street to <br />a point approximately sixty-six feet (66') South of the <br />North right-of-way of the first east -west alley North of <br />East Sorin Street; and Neddo Court, from the North right- <br />of-way line of the first east -west alley North of East <br />Sorin Street to the South right-of-way line of the <br />Second east -west alley North of East Sorin Street. <br />It is noted that on May 4, 1992, the Board of Public Works tabled <br />making a recommendation on a Vacation Petition as submitted by <br />Mr. Sauers to close the following: <br />East Sorin Street from the west right-of-way line of <br />N. Niles Avenue to the St. Joseph River; the first and <br />second east -west alleys south of vacated Hagerty Street, <br />from the west right-of-way line of N. Niles Avenue, to <br />the east right-of-way line of the first north -south alley <br />west of N. Niles Avenue; and the first north -south alley <br />west of N. Niles Avenue, from the north right-of-way line <br />of E. Sorin Street to the north right-of-way line of the <br />first east -west alley south of vacated Hagerty Street. <br />Parts located in Coquillard's First Addition in the City <br />of South Bend, Indiana. <br />It is further noted that since this matter was tabled on May 4, <br />1992, the Vacation Petition has been amended to vacate only the <br />property as first referenced above. <br />Mr. Leszczynski informed members of the Board that the <br />Engineering Department, Department of Economic Development, Area <br />Plan Commission, Police Department and Fire Department have all <br />submitted favorable recommendations concerning this second <br />amended vacation. <br />Assistant City Attorney Jenny Pitts Manier indicated that the <br />Department of Economic Development has been working with Madison <br />Center and recommend that the Board submit a favorable <br />recommendation to the Common Council concerning this vacation <br />with the understanding that Madison Center grant to the City a <br />fourteen foot (14') Easement for a walkway across <br />1 <br />
