Affidavit was in order, <br />Commitment form was completed and <br />Bond was submitted. <br />BID: $244,196.90 <br />Upon a motion made by <br />and carried, the above <br />Department for review <br />Vick, President, Non - <br />Non -Discrimination <br />a five per cent (5%) Bid <br />Mr. Leszczynski, seconded by Mr. Caldwell <br />bids were referred to the Engineering <br />and recommendation. <br />PUBLIC HEARING - DENIAL OF TAXI DRIVER'S LICENSE - RYCE E. DAVIS <br />Mr. Leszczynski advised that this was the date set for the Board's <br />Public Hearing concerning the City Controller's denial of the taxi <br />driver's license application of Mr. Ryce E. Davis, 505 West <br />Washington Street, South Bend, Indiana. This Public Hearing is <br />being conducted at the request of Mr. Davis. <br />For the record, it is noted that the Board is in receipt of a <br />letter from Mr. Kevin C. Horton, City Controller, advising that <br />pursuant to section 4-61(pp)(2) of the South Bend Municipal Code, <br />he is required to submit, in writing, to the Board his reasons for <br />rejecting applications for taxicab drivers licenses. <br />Mr. Horton stated that pursuant to Section 4-61 of the Code, the <br />City Controller is charged with the review and approval of taxicab <br />drivers licenses. Before the determination is made on any given <br />license, the ordinance requires an investigation of the traffic <br />and police record of the applicant. Mr. Davis' limited criminal <br />history, which was received from the Indiana State Police <br />archives, shows a criminal history on the part of the applicant as <br />follows: <br />1. Applicant was convicted in October, 1980, of criminal <br />conversion and was sentenced to ninety (90) days in the <br />County Jail and one (1) year probation. <br />2. Applicant was convicted in January, 1981, of theft, a <br />Class D felony, and was sentenced to two (2) years at <br />the Plainfield Diagnostic Center. <br />3. Applicant was convicted in August, 1981, of theft, and <br />was sentenced to two (2) years at the Indiana <br />Reformatory in Pendleton. <br />The transcript of the applicant's driving record from the State <br />Bureau of Motor Vehicles shows several convictions over the last <br />few years. Most notable are the following: <br />1. May, 1986 - Driving while suspended <br />2. May, 1987 - Driving while suspended <br />3. September, 1989 - Operating while intoxicated <br />4. January, 1991 - Operating while intoxicated <br />Mr. Horton further stated that as noted above, Mr. Davis has <br />problematic criminal and driving records. Since Mr. Davis has had <br />no criminal convictions since 1981, Mr. Horton indicated that he <br />is inclined to disregard the criminal history. However, Mr. <br />
