042 <br />REGULAR MEETING FEBRUARY 8, 1993 <br />Magliozzi indicated that Cole Associates entered into an <br />Agreement with the City in 1990 which was divided into five (5) <br />or six (6) phases. Phases I, II and III have been completed and <br />accomplished with the publication of a final annexation report. <br />At this time the City has chosen a more flexible approach to <br />annexations and further work will be done in-house. Therefore, <br />at this time, pursuant to the terms of the Agreement, the <br />contract is suspended. Mr. Leszczynski made a motion that the <br />Notice of Suspension of Services be approved and executed. Mrs. <br />Mueller seconded the motion which carried. <br />APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHT TO REMONSTRATE <br />Mr. Leszczynski stated that the Board is in receipt of a Consent <br />to Annexation and Waiver of Right to Remonstrate as submitted by <br />Donald K. and Diane J. Riggle. The Consent indicates that in <br />consideration for permission to tap into the public sanitary <br />sewer system of the City, to provide sanitary sewer service to <br />201 East Cripe Street, South Bend, Indiana, (Key #03-1129-0091), <br />the Riggle's waive and release any and all right to remonstrate <br />against or oppose any pending or future annexation of the <br />property by the City of South Bend. Therefore, Mrs. Mueller made <br />a motion that the Consent be approved. Mr. Leszczynski seconded <br />the motion which carried. <br />APPROVE INDIANA DEPARTMENT OF TRANSPORTATION - REPORT OF CONTRACT <br />FINAL INSPECTION AND RECOMMENDATION FOR ACCEPTANCE - CBD <br />SIGNALIZATION PROJECT <br />Mr. Leszczynski indicated that the Board is in receipt of an <br />Indiana Department of Transportation Report of Contract Final <br />Inspection and Recommendation for Acceptance in conjunction with <br />the downtown signalization project. Mr. Leszczynski made a <br />motion that the Report be approved and executed. Mrs. Mueller <br />seconded the motion which carried. <br />APPROVE FINAL CHANGE ORDER - CBD SIGNALIZATION PROJECTS <br />Mr. Leszczynski advised that the Indiana Department of <br />Transportation has submitted a Change Order indicating a decrease <br />of $60,923.70 for the above referred to project. Mrs. Mueller <br />made a motion that the Change Order be approved and executed. <br />Mr. Leszczynski seconded the motion which carried. <br />APPROVE ACCESS AGREEMENT - SAFETY-KLEEN CORPORATION <br />Board Attorney and Member Mary H. Mueller advised that the Board <br />is in receipt of an Agreement between the City and Safety-Kleen <br />Corporation, 777 Big Timber Road, Elgin, Illinois, in regards to <br />the installation and operation of a monitoring well in the public <br />right-of-way at the intersection of Western Avenue and Carlisle <br />Street. <br />It is noted that Safety-Kleen needs access to a portion of the <br />intersection to install a monitoring well in order to complete <br />environmental testing. Mrs. Mueller further noted that this <br />Agreement protects and allows the City to control the situation <br />to make sure it is done in a safe fashion. Mr. Leszczynski made <br />a motion that the Agreement be approved and executed. Mrs. <br />Mueller seconded the motion which carried. <br />APPROVE CHANGE ORDERS: <br />- NO. 1 - MAYFLOWER ROAD - PHASE I (FROM OLD CLEVELAND ROAD <br />TO RELOCATED OLD CLEVELAND ROAD) <br />- NO. 1 - NIMTZ PARKWAY (EXTENSION) <br />- NO. 1 - OLD CLEVELAND ROAD RELOCATED <br />Mr. Leszczynski advised that the following Contractors have <br />submitted Change Order No. 1 for the following projects: <br />
