REGULAR MEETING <br />NOVEMBER 7. 1994 <br />The alleys to be vacated are described as the first east -west alley north of vacated E. Sorin <br />St. from the west right-of-way line of N. Niles Ave. to the west right-of-way line of the first <br />north -south alley (Neddo Ct.) west of N. Niles Ave. for a distance of approximately 179 feet <br />and a width of approximately 14 feet. Also the second east -west alley north of vacated E. <br />Sorin St. from the west right-of-way line of N. Niles Ave. to the west right-of-way line of <br />the first vacated north -south alley (Neddo Ct.) west of N. Niles Ave. for a distance o <br />approximately 179 feet and a width of approximately 14 feet. Also the first north -south alle <br />(Neddo Ct.) east of N. Niles Ave. from the south right-of-way line of the first east -west allZf <br />north of vacated E. Sorin St., south for a distance of approximately 60 feet and a width <br />approximately 14 feet. Part situated in Coquillard's Addition to the City of South Bend, <br />Indiana. <br />Mr. Leszczynski advised that the Board is in receipt of favorable recommendations concerning this <br />Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation, <br />Department of Economic Development and the Department of Public Works. Therefore, Mrs. <br />Manier made a motion that the Board send a favorable recommendation to the Common Council <br />concerning this Vacation Petition. Mr. Leszczynski seconded the motion which carried. <br />APPROVAL OF RESOLUTION NO. 41-1994 - TRANSFER OF PROPERTY FROM <br />EQUIPMENT SERVICES TO PARK DEPARTMENT <br />Upon a motion made by Mr. Manier, seconded by Mr. Leszczynski and carried, the following <br />Resolution No. 41-1994 was adopted by the Board to transfer a vehicle to the Park Department: <br />RESOLUTION NO.41-1994 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF <br />THE CITY OF SOUTH BEND, INDIAN, TRANSFERRING <br />A VEHICLE TO THE PARK DEPARTMENT <br />WHEREAS, pursuant to I.C. 36-9-6-3, the Board of Public Works of the City of South Bend (the <br />Board) has custody of all personal property of the City of South Bend; and <br />WHEREAS, the Division of Equipment Services is the owner of certain personal property <br />described as follows: <br />One 1985 1/2 ton Chevy Pick-up Truck <br />#VIN 2GC9CI4H8F1158517; and <br />WHEREAS, Equipment Services has determined that the vehicle is no longer needed for its <br />operation and desires to transfer the vehicle to the Park Department for the negotiated sum of Five <br />Hundred Dollars ($500.00); and <br />WHEREAS, the Park Department is interested in obtaining the vehicle and is willing to pay <br />Five Hundred Dollars ($500.00) to Equipment Services for the vehicle; and <br />WHEREAS, pursuant to I.C. 36-1-11-8, governmental entities may exchange property with <br />one another upon terms and conditions agreed upon by the two entities as evidenced by the adoption <br />of substantially identical resolutions by each entity. <br />NOW, THEREFORE, BE IT RESOLVED by the South Bend Board of Park Commissioners, <br />as follows: <br />1) That the transfer of the Chevy Pick -Up Truck described above, by Equipment <br />Services to the Park Department for the sum of Five Hundred Dollars ($500.00) shall be, and hereby <br />is, approved. <br />
