<br />REGULAR MEETING
<br />MARCH 21, 1994
<br />The regular meeting of the Board of Public Works was convened at
<br />9:34 a.m. on Monday, March 21, 1994, by Board President John E.
<br />Leszczynski, with Mr. Leszczynski, Mr. James R. Caldwell and Mrs.
<br />Jenny Pitts Manier present.
<br />AGENDA ITEM ADDED
<br />Upon a motion made by Mr. Leszczynski, seconded by Mrs. Manier and
<br />carried, a Lease Agreement between the Fraternal Order of Police
<br />Lodge No. 36 and the City of South Bend was added to the agenda.
<br />APPROVE MINUTES OF PREVIOUS MEETING
<br />Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and
<br />carried, the minutes of the regular meeting of the Board held on
<br />March 14, 1994, were approved as submitted.
<br />DRYBROUGH, TRANEX CAR SALES, INC., D/B/A VAL CAR RENTAL SALES
<br />Mr. Leszczynski reminded members of the Board that at their last
<br />meeting, it was determined that the Public Hearing concerning the
<br />transient merchant license application as submitted by Ms. Sharon
<br />Drybrough, Tranex Car Sales, Inc., would be tabled until this date
<br />as Ms. Drybrough was not in attendance at that meeting.
<br />Ms. Sharon Drybrough, 632 Springmill Lane, Indianapolis, Indiana,
<br />representing Tranex Car Sales, Inc., d/b/a Val Car Rental Sales,
<br />5075 West 38th Street, Indianapolis, Indiana, was present and
<br />informed the Board that Tranex Car Sales intends to sell used
<br />vehicles in South Bend on Wednesday, April 13, 1994 through
<br />Friday, April 15, 1994 from 9:OO a.m. to 9:00 p.m. and on
<br />Saturday, April 16, 1994, from 9:00 a.m. to 6:00 p.m. in the K-
<br />Mart parking lot, 4640 South Michigan Street, South Bend, Indiana.
<br />Mr. Leszczynski inquired of Ms. Drybrough if this is the first
<br />time the company has done this type of sale in South Bend. Ms.
<br />Drybrough advised that this is not the first time. A used car
<br />sale was conducted last Fall. Ms. Drybrough stated that she was
<br />not aware of any sales conducted in this area prior to that time.
<br />Mr. Caldwell asked Ms. Drybrough what people can do if they have a
<br />problem and Tranex Car Sales, Inc., is gone and whether or not
<br />this type of situation has arisen in the past. Ms. Drybrough
<br />advised that she has not had anyone call her after a sale but a
<br />problem would be handled based on the individual problem.
<br />Board members inquired if Ms. Drybrough would be the person to
<br />call if a customer had a problem. Ms. Drybrough indicated that
<br />her name is listed on the application form as the contact person
<br />who will be available for at least sixty (60) days following the
<br />last date of business who will respond to consumer complaints.
<br />Mr. Craig Kapson, 1401 Olivia Circle, South Bend, Indiana,
<br />representing Jordan Ford, 609 East Jefferson Boulevard, Mishawaka,
<br />Indiana, was present and stated that he is against this
<br />application.
<br />Mr. Kapson informed the Board that he has a dealership in
<br />Mishawaka, Indiana and his objections are being raised not only as
<br />a merchant but as a concerned citizen. He stated that this
<br />company has no investment in this community and that full
<br />disclosure is not available to the customer. He asked that a full
<br />disclosure be made to the customer that this is an out of town
<br />company. Also, where they can seek advise and assistance so they
<br />are protected.
<br />Mr. Kapson stated that this company was previously Budget Car
<br />Sales. He noted that they are mailing out one thousand dollar
