Jacob, Clerk <br />ADOPT RESOLUTION NO. 66-1995 - TRANSFERRING A 1968 AMERICAN LAFRANCE <br />FIRE TRUCK TO THE TOWN OF LAKEVILLE <br />Upon a motion made by Mr. Leszczynski , seconded by Mr. Caldwell and carried, the following <br />Resolution was adopted by the Board of Public Works: <br />RESOLUTION NO. 66-1995 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF <br />THE CITY OF SOUTH BEND, INDIANA, TRANSFERRING <br />A 1968 AMERICAN LAFRANCE FIRE TRUCK <br />TO THE TOWN OF LAKEVILLE <br />WHEREAS, pursuant to I.C. 36-9-6-3, the Board of Public Works of the City of South Bend (the <br />Board) has custody of all personal property of the City of South Bend; and <br />WHEREAS, pursuant to I.C. 36-18-13-3, the Town of Lakeville Town Council (the Township) <br />approves the purchase of all firefighting apparatus for the Township; and <br />WHEREAS, the City of South Bend is the owner of a certain personal property described as follows: <br />One (1) 1968 American LaFrance Fire Truck, Serial # 1211059 <br />WHEREAS, the Board has determined that such equipment is no longer needed for the operation <br />of the Fire Department of the City of South Bend and desires to transfer said equipment to the Town of <br />Lakeville, for the negotiated sum of Four Thousand Dollars ($4,000.00); and <br />WHEREAS, the Members are interested in obtaining said equipment for the Town of Lakeville and <br />are willing to pay Four Thousand Dollars ($4,000.00) to the City of South Bend for such equipment; and <br />WHEREAS, pursuant to I.C. 36-1-11-8, governmental entities may exchange property with one <br />another upon terms and conditions agreed upon by the two entities as evidenced by the adoption of <br />substantially identical resolutions by each entity. <br />NOW THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South Bend, <br />Indiana, as follows: <br />1) That the transfer of the 1968 American LaFrance Fire Truck described above to the Town <br />of Lakeville for the sum of Four Thousand Dollars ($4,000.00) shall be, and hereby is, approved. <br />2) That upon the payment of Four Thousand Dollars ($4,000.00) from the Town of Lakeville <br />to the City of South Bend, the equipment described above will be released by the City of South Bend. <br />
