REGULAR MEETING AUGUST 21 1995 WHEREAS, Midwest Land Company desires to secure from the Board of Public Works certain assurances with respect to access to Nimtz Parkway. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF PUBLIC WORKS that the public street, located within the City of South Bend known as Nimtz Parkway, between the entrance to the Indiana Toll Road and the property known as Lot No. 1 in 1 st Blackthorn Industrial Minor Subdivision presently is designated as a truck route and shall remain a truck route in the future, permitting trucks to drive from the Indiana Toll Road exit to the subject property and from the subject property to the Indiana Toll Road exit west of the subject property and that the City of South Bend shall not at any time in the future prohibit trucks from using said street and shall not impose any tariffs, weight restrictions greater than those presently in effect or other restrictions which would impede or restrict truck traffic to and from said property and the Indiana Toll Road exit. Jacob, Clerk ADOPT RESOLUTION NO. 59-1995 - APPROVE THE TRADE-IN OR EXCHANGE OF CITY - OWNED PROPERTY OR PROPERTY OF SIMILAR NATURE Upon a motion made by Mr. Caldwell, seconded by Mrs. Manier and carried, the following Resolution was adopted: RESOLUTION NO.59-1995 A RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC WORKS APPROVING THE TRADE-IN OR EXCHANGE OF CITY -OWNED PROPERTY OF SIMILAR NATURE WHEREAS, it has been determined by the Board of Public Works of the City of South Bend that the following described property is unfit for the purpose for which it was intended and should be traded for property of a similar nature: ONE (1) 1987 PONTIAC - VIN# 1G2AF51R7HT219629 WHEREAS, it has been determined by the Board of Public Works of the City of South Bend that the following described property is of a similar nature to the above described property and should be purchased with the above described property being traded in for the following property: ONE (1) 1994 CHEVROLET - LUMINA - VIN# 2G1WL54TXR1108638 WHEREAS, I.C. 36-1-11-0 authorizes the Board of Public Works to trade in or exchange City -owned property for partial or full reduction in the purchase price of the property of a similar nature. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, AS FOLLOWS: 1.
