019 <br />REGULAR MEETING JULY 31, 1995 <br />WHEREAS, the Board of Public Works now wishes to take the necessary action to make it <br />possible for the Board, in the future, to sell said parcel of real estate pursuant to State statutes. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South <br />Bend, Indiana: <br />1. That the parcel of real estate owned by the City contained in the following list <br />is not necessary to the public use, is not set aside by State or City laws for public <br />purposes, that the cost of maintaining said parcel equals or exceeds the estimated fair <br />market value of said parcel and the highest and best use of said parcel is sale to an <br />abutting landowner: <br />ADDRESS <br />1021 Western Avenue <br />Key No. 18-3069-2686 <br />Lot 1 Willett's Sub of BOL 89 <br />ADOPTED this 31 st day of July, 1995. <br />ATTEST: <br />s/Angela K. Caldwell, Member <br />ADOPT RESOLUTION NO. 51-1995 - DISPOSAL OF CITY -OWNED PROPERTY <br />Upon a motion made by Mr. Caldwell, seconded by Mr. Leszczynski and carried, the following <br />resolution was adopted: <br />RESOLUTION NO. 51-1995 <br />WHEREAS, I.C. 36-9-6-1 gives the Board of Public Works of the City of South Bend the <br />right and duty to have custody of, control of, use of, and dispose of in accordance with Indiana <br />statutes, all real and personal property owned by the City of South Bend; and <br />WHEREAS, the Common Council of the City of South Bend passed as amended on January <br />9, 1995, Ordinance No. 8570-95 which states that upon retirement with twenty (20) or more years <br />of service: <br />"Upon retirement with twenty (20) or more years of service to the City of South Bend, <br />Indiana, a sworn member of the South Bend Fire Department shall be entitled to retain as his <br />or her own personal property, the fire helmet used by such Firefighter immediately prior to <br />giving notice of his or her retirement." <br />and <br />WHEREAS, William Crittendon has retired from the South Bend, Indiana Fire Department <br />after twenty (20) or more years of service, and the Board of Public Safety of the City of South Bend, <br />Indiana has determined that they have retired in good standing; and <br />WHEREAS, I.C.. 36-1-11-6 permits and established procedure for disposal of personal <br />property which is no longer needed by the City and which is unfit for the purpose for which it was <br />intended; and <br />
