Wenger's Sixth <br />Addition to the City of South Bend, recorded April 1, 1903 in the Office of the Recorder <br />of St. Joseph County, Indiana, in Plat Book 8, page 103. Key No. 18-7014-0530 <br />(hereinafter collectively referred to as the Real Property) and; <br />WHEREAS, pursuant to I.C. 36-9-6-3, the Board of Public Works of the City of South Bend (the <br />"Board") has custody of and may maintain all real property of the City of South Bend; and <br />WHEREAS, pursuant to IC. 36-1-11-1 (b), the City of South Bend, acting by and through the <br />Board, may exchange or transfer property with an Indiana non profit corporation organized for <br />educational, literary, scientific, religious, or charitable purposes that is exempt from federal income <br />taxation under Section 501 of the Internal Revenue Code ("Indiana nonprofit corporation") upon <br />such terms and conditions as the parties agree; and <br />WHEREAS, the South Bend Heritage Foundation, Inc. (SBHF) is an Indiana nonprofit <br />corporation and is desirous of acquiring the Real Property from the City so that SBHF may construct <br />housing units for lower income residents upon the Real Property; and <br />WHEREAS, the City, through the Board, is desirous of transferring the Real Property to SBHF <br />for a nominal sum so that the Real Property may be used for that purpose; and <br />WHEREAS, SBHF desires to acquire the Real Property free and clear of all structures which are <br />currently located upon Parcels II, III, IV, and V of the Real Property; and <br />WHEREAS, the South Bend Redevelopment Commission has agreed with the City to accept <br />financial responsibility for the removal of such structures from the Real Property. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE <br />CITY OF SOUTH BEND AS FOLLOWS: <br />
