REGULAR MEETING APRIL 22, 1996 <br />ADOPT RESOLUTION NO. 33-1996 - TRANSFER OF REAL PROPERTY TO FAMILY & <br />CHILDREN' S CENTER PROPERTIES MANAGEMENT, INC <br />Upon a motion made by Mrs. Manier, seconded by Mr. Caldwell and carried, the following <br />Resolution was adopted by the Board of Public Works: <br />RESOLUTION NO. 33-1996 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, INDIANA, <br />APPROVING THE TRANSFER OF REAL PROPERTY <br />TO FAMILY & CHILDREN'S CENTER PROPERTIES MANAGEMENT, INC. <br />WHEREAS, the City of South Bend, Indiana (the "City") is the owner of the following <br />described real property situated in St. Joseph County, Indiana: <br />That part of the Northeast Quarter of Section 13, Township 37 North, Range Two East, City <br />of South Bend, St. Joseph County, Indiana, which is described as: Beginning at a point on <br />the North line of Keasey Street which is South 89 degrees 38 minutes 03 seconds East, 35.00 <br />feet from the Southwest corner of Lot 99 as shown on the recorded Plat of "Wenger & <br />Krieghbaum's 1 st Addition;" thence North 1 degree 03 minutes 32 seconds East, 606.33 feet <br />to a 5/8" capped rebar set on the South line of Sample Street which is South 89 degrees 10 <br />minutes 03 seconds East, 35.00 feet from the Northwest corner of Lot 1 as shown on said <br />recorded Plat; thence South 89 degrees 10 minutes 03 seconds East, 213.55 feet; thence <br />South 56 degrees 06 minutes 12 seconds East, 177.69 feet; thence South 60 degrees 49 <br />minutes 39 seconds East, 54.83 feet; thence South 56 degrees 50 minutes 24 seconds East, <br />279.71 feet; thence South 57 degrees 10 minutes 37 seconds East 207.90 feet; thence South <br />00 degrees 12 minutes 10 seconds West, 216.90 feet; thence North 89 degrees 38 minutes <br />03 seconds West, 828.22 feet to the Point of Beginning. Containing 8.73 acres <br />(hereinafter referred to as the Real Property) and; <br />WHEREAS, pursuant to I.C. 36-9-6-3, the Board of Public Works of the City of South Bend <br />(the "Board") has custody of and may maintain all real property of the City of South Bend; and <br />WHEREAS, the City, through the Board, is desirous of transferring the Real Property to <br />Family & Children's Center Properties Management, Inc., an Indiana non-profit corporation, exempt <br />from income taxation under Section 5030 of the Internal Revenue Code, for use in the <br />redevelopment of the Sample -Ewing Development Area, specifically, the development of a new <br />Boys and Girls Club facility; and <br />WHEREAS, pursuant to I.C. 36-1-11-1(b), the City, acting by and through the Board, may <br />transfer property to an Indiana non-profit corporation, exempt from income taxation under Section <br />5030 of the Internal Revenue Code, under such terms and conditions as determined by the Board. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS <br />FOR THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: <br />1. That the transfer of the Real Property situated in St. Joseph County, Indiana, and generally <br />described as follows: <br />That part of the Northeast Quarter of Section 13, Township 37 North, Range Two East, City <br />of South Bend, St. Joseph County, Indiana, which is described as: Beginning at a point on <br />the North line of Keasey Street which is South 89 degrees 38 minutes 03 seconds East, 35.00 <br />feet from the Southwest corner of Lot 99 as shown on the recorded Plat of "Wenger & <br />Krieghbaum's 1 st Addition;" thence North 1 degree 03 minutes 32 seconds East, 606.33 feet <br />to a 5/8" capped rebar set on the South line of Sample Street which is South 89 degrees 10 <br />minutes 03 seconds East, 35.00 feet from the Northwest corner of Lot 1 as shown on said <br />
