REGULAR MEETING <br />in Plat Book 6, page 21. Key No. 18-7023-0915. <br />MARCH 4. 1996 <br />Part of Lots Numbered One Hundred Sixteen (116) and One Hundred Twenty-three <br />(123) as shown on the recorded Plat of Martin L. Wenger's Fifth Addition to the City <br />of South Bend, described as beginning at a point Forty (40) feet North of the <br />Southeast corner of Lot Numbered One Hundred Twenty-three (123) in said <br />Addition; running thence North on the East line of said Lots, Forty (40) feet; thence <br />West Ninety-six (96) feet to a Twelve (12) foot alley which crosses said Lots from <br />North to South; thence South on the East line of said alley Forty (40) feet; thence <br />East Ninety-six (96) feet to the place of beginning, in St. Joseph County, Indiana. <br />Key No. 18-7023-0898. <br />A part of Lot Numbered One Hundred Sixteen (116) as shown on the recorded Plat <br />of Martin L. Wenger's Fifth Addition to the City of South Bend, recorded June 17, <br />1892 in the Office of the Recorder of St. Joseph County, Indiana, in Plat Book 6, <br />page 21, bounded by a line running as follows, viz: Beginning at the Northeast <br />corner of said Lot Numbered 116; thence running West on the North line of said lot, <br />96 feet to the East line of a 12 foot alley; thence running South on the East line of <br />said alley, 40 feet; thence running East 96 feet to the East line of said Lot and the <br />West line of Marietta Street in said City; thence running North on said line 40 feet <br />to the place of beginning. Key No. 18-7023-0897. <br />ADOPT RESOLUTION NO. 17-1996 - TRANSFER OF CITY OWNED PROPERTY <br />Upon a motion made by Mr. Caldwell, seconded by Mr. Leszczynski and carried, the following <br />Resolution was adopted by the Board of Public Works: <br />RESOLUTION NO. 17-1996 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, INDIANA, <br />TRANSFERRING PIRSCH MIDI PUMPER TO FORAKER TOWNSHIP <br />WHEREAS, pursuant to I.C. 36-9-6-3, the Board of Public Works of the City of South Bend <br />("the Board") has custody of all personal property of the City of South Bend; and <br />WHEREAS, pursuant to I.C. 36-8-13-3, the Foraker Township Board of Directors ("the <br />Township") approves the purchase of all firefighting apparatus for the Township; and <br />WHEREAS, the City of South Bend is the owner of certain personal property described as <br />follows: <br />PIRSCH MIDI PUMPER <br />1985 G.M.C. TOP KICK PUMPER/MIDI <br />VIN # I GPM7D 1 YFV627175; and <br />WHEREAS, the Board has determined that such equipment is no longer needed for the <br />operation of the Fire Department of the City of South Bend and desires to transfer said equipment <br />to Foraker Township, for the negotiated sum of Forty Thousand Dollars ($40,000.00); and <br />WHEREAS, the Trustee is interested in obtaining said equipment for the Foraker Township <br />Fire Department and is willing to pay Forty Thousand Dollars ($40,000.00) to the City of South <br />Bend for such equipment; and <br />WHEREAS, pursuant to I.C. 36-1-11-8, governmental entities may exchange property with <br />one another upon terms and conditions agreed upon by the two entities as evidenced by the adoption <br />of substantially identical resolutions by each entity. <br />
