UNFAVORABLE RECOMMENDATION - PETITION TO VACATE AN ALLEY Mr. Caldwell indicated that the Common Council has submitted to the Board a Vacation Petition as completed by Mr. John Ford, Jones, Obenchain, Ford, Pankow, Lewis & Woods, 1800 Valley American Bank Building, South Bend, Indiana, to vacate the following alley: The south 12.5 feet of the original 82.5 foot right-of-way from the East right-of-way of North Notre Dame Avenue to the West right-of-way of the first North/South alley East of North Notre Dame Avenue and South of East Madison Street, for a distance of approximately 165 feet and also the South 12.5 feet of East Madison Street of the original 82.5 foot right-of-way from the East right-of-way of the first North/South alley East of North Notre Dame Avenue and South of East Madison Street, to the West right-of-way of North Frances Street for a distance of approximately 165 feet. Mr. Caldwell advised that the Board is in receipt of favorable recommendations concerning this Vacation Petition from the Area Plan Commission, Police Department, Fire Department and Sanitation. The Department of Community and Economic Development and the Division of Engineering sent an unfavorable recommendation, as there is a water main in the area to be vacated, and the area in question is a public way. Therefore, Ms. Roemer made a motion that the Board send an unfavorable recommendation to the Common Council concerning this Vacation Petition. Mr. Caldwell seconded the motion which carried.
