REGULAR MEETING FEBRUARY 3, 1997
<br />The regular meeting of the Board of Public Works was convened at on Monday, February 3, 1997,
<br />at 9:35 a.m., by Board Member James R. Caldwell, with Board Member M. Catherine Roemer
<br />present. Also present was Board Attorney Anne Bruneel.
<br />AGENDA ITEM ADDED
<br />Upon a motion made by Mr. Caldwell, seconded by Mrs. Roemer and carried, an agenda item for a
<br />Construction Contract for the Century Center Cooling Tower Replacement was added.
<br />APPROVE MINUTES OF PREVIOUS MEETING
<br />Upon a motion made by Mrs. Roemer, seconded by Mr. Caldwell and carried, the minutes of the
<br />regular meeting of the Board held on January 27, 1997, were approved.
<br />PUBLIC HEARING - INTENT TO LEASE ADDITIONAL OFFICE SPACE AT 205 WEST
<br />JEFFERSON FOR THE USE OF THE ST. JOSEPH COUNTY/SOUTH BEND BUILDING
<br />DEPARTMENT/RESOLUTION NO. 7-1997 ADOPTING INTENT TO LEASE
<br />This was the Public Hearing in conjunction with the intent to lease additional office space at 205 West
<br />Jefferson for the use of the St. Joseph County/South Bend Building Department. Upon a motion
<br />made by Mr. Caldwell, seconded by Mrs. Roemer and carried, the following Resolution was adopted
<br />by the Board of Public Works.

<br />RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE
<br />CITY OF SOUTH BEND, INDIANA, CONFIRMING ITS
<br />INTENT TO LEASE ADDITIONAL OFFICE SPACE AT 205 WEST JEFFERSON
<br />BOULEVARD, SOUTH BEND, INDIANA, FOR THE USE OF THE ST.
<br />JOSEPH COUNTY/SOUTH BEND BUILDING DEPARTMENT
<br />WHEREAS, the Board of Public Works of the City of South Bend, Indiana ('Board"), on
<br />January 20, 1997, adopted a Resolution 76-1996 entitled A RESOLUTION OF THE BOARD OF
<br />PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, DECLARING ITS INTENT TO
<br />LEASE ADDITIONAL OFFICE SPACE AT 205 WEST JEFFERSON BOULEVARD, SOUTH
<br />BEND, INDIANA, FOR THE USE OF THE ST. JOSEPH COUNTY/SOUTH BEND BUILDING
<br />DEPARTMENT ("Resolution"), in which it declared its intent to lease additional office space at 205
<br />West Jefferson Boulevard, South Bend, Indiana ("Premises"), for the use of the St. Joseph
<br />County/South Bend Building Department (Building Department) from the 1 st Source Bank of South
<br />Bend, Indiana, for a term of one (1) year, with an option to renew for an additional one-year period,
<br />at the same annual rental, with the annual rental of said premises not to exceed Six Thousand Seven
<br />Hundred Thirty-nine and 92/100 Dollars ($6,739.92); and
<br />WHEREAS, the Resolution provided for public hearing on February 3, 1997, at 9:30 a.m.,
<br />in the Board of Public Works Meeting Room, 1308 County -City Building, South Bend, Indiana
<br />46601, at which hearing all persons wishing to be heard could address the Board as to whether the
<br />execution of the proposed lease is necessary and whether the proposed rental is fair and reasonable
<br />for the Premises; and
<br />WHEREAS, pursuant to I.C. 36-1-10-13, notice of the public hearing on the proposed lease
<br />was published one (1) time in the South Bend Tribune and Tri-CouM News on January 24, 1997;
<br />and
<br />WHEREAS, the public hearing was held pursuant to the notice and the Resolution, _
<br />written remonstrances were filed, and all interested persons were heard at the public hearing; and
<br />WHEREAS, on January 27, 1997, the South Bend Common Council adopted Resolution
<br />entitled A RESOLUTION OF THE SOUTH BEND COMMON COUNCIL
<br />DETERMINING, AFTER INVESTIGATION, THAT THE LEASE OF ADDITIONAL OFFICE
