<br />REGULAR MEETING JANUARY 13, 1997
<br />The regular meeting of the Board of Public Works was convened at 9:3 5 a.m. on Monday, January
<br />13, 1997, by Board President John E. Leszczynski, with Mr. Leszczynski and Mrs. M. Catherine
<br />Roemer present. Board Member James R. Caldwell was not present. Also present was Board
<br />Attorney Anne Bruneel.
<br />APPROVE MINUTES OF PREVIOUS MEETING
<br />Upon a motion made by Mr. Leszczynski, seconded by Mrs. Roemer and carried, the minutes of the
<br />regular meeting of the Board held on January 6, 1997, were approved.
<br />PUBLIC HEARING - TRANSIENT MERCHANT LICENSE - MICHIANA BOAT AND
<br />OUTDOOR SHOW
<br />Mr. Leszczynski advised that this was the date set for the Board's Public Hearing concerning a
<br />Transient Merchant License for the Michiana Boat and Outdoor Show, to be held from January 31,
<br />1997 through February 2, 1997, to conduct the sale of boats and fishing tackle at the Century Center,
<br />as submitted by Mr. Melvin E. Wood, 326 North Victoria, Mishawaka, Indiana. Mr. Wood was
<br />present, and stated that this show would be the same as last year's, and that the show was very
<br />successful.
<br />There being no one else present wishing to address the Board concerning this matter, the Public
<br />Hearing was closed. Therefore, upon a motion made by Mr. Leszczynski, seconded by Mrs. Roemer
<br />and carried, the Application for a Transient Merchant License was approved.
<br />APPROVAL OF APPLICATION FOR A CERTIFICATE OF PUBLIC CONVENIENCE - ACE
<br />CAB LINES
<br />Mr. Leszczynski advised that this was the date set for the Board's Public Hearing concerning an
<br />Application for a Certificate of Public Convenience for Ace Cab Lines, as submitted by Mr. Robert
<br />M. Personett, 300 East High Street, Elkhart, Indiana. Mr. Mike Personett, 300 East High Street, was
<br />present, and stated that Ace Cab Company would like to be licensed in South Bend. They have six
<br />(6) cabs available, have a twenty-four (24) hour service, and will abide by the South Bend Municipal
<br />Code.
<br />Mr. Roger Woods, Roseland Cab, was present, and questioned as to whether Ace Cab would be
<br />available twenty-four (24) hours for service. Mr. Walter Jones, ABC Cabs, was present, and stated
<br />that Mr. Personett operates his cab company in Elkhart, and has a monopoly there, and is subsidized
<br />in his operations in the amount of $200,000.00. Mr. Personett replied that he does have higher
<br />insurance than what is required in South Bend.
<br />Mr. Jim Pather, Mishawaka Cab Company, was present, and questioned as to whether Ace Cab
<br />would be able to respond to the local clientele. Mr. Leszczynski responded that if customers call for
<br />his Cab Company, he would need to find a way to pick them up.
<br />Ms. Bruneel stated that the Municipal Code states that if the applicant is fit, willing, and able to
<br />provide service, and obligates to providing a central place of business, twenty-four (24) hour service,
<br />and has the necessary meters and inspections, a Certificate of Public Convenience may be issued.
<br />Therefore, upon a motion made by Mr. Leszczynski, seconded by Mrs. Roemer and carried, the
<br />Application for a Certificate of Public Convenience was approved.
<br />OPENING OF BIDS - NEAR WESTSIDE PARTNERSHIP CENTER SERVICE AREA -
<br />SIDEWALK, CURB AND APPROACH REPAIRS - PROJECT NO. 96-46
<br />This was the date set for receiving and opening of sealed bids for the above referred to project. The
<br />Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri-County News
<br />which were found to be sufficient. The following bids were opened and publicly read:
