<br />The regular meeting of the Board of Public Works was convened at 9:40 a.m. on Monday, October
<br />19, 1998, by Board President James R. Caldwell, with Mr. Lewis N. Powell and Ms. M. Catherine
<br />Roemer present. Also present was Board Attorney Michelle Engel.
<br />TABLE AGENDA ITEM
<br />Upon a motion made by Mr. Caldwell, seconded by Mr. Powell and carried, the agenda for an
<br />Agreement for Cincinnati Bell Long Distance Services was tabled.
<br />APPROVE MINUTES OF PREVIOUS MEETING
<br />Upon a motion made by Ms. Roemer, seconded by Mr. Powell and carried, the minutes of the regular
<br />meeting of the Board held on October 5, 1998, October 9, 1998, and October 12, 1998, were
<br />approved.
<br />PUBLIC HEARING - TRANSIENT MERCHANT LICENSE - HOMIER DISTRIBUTING
<br />COMPANY
<br />Mr. Caldwell advised that this was the date set for the Board's Public Hearing concerning an
<br />Application for a Transient Merchant License, as submitted by Mr. Timothy Wick, 312 West River,
<br />Bourbonnais, Illinois, to conduct the Chuck Homier's Sale at the Reserve Center at 1901 South
<br />Kemble Street, South Bend, Indiana, on December 17 through December 20, 1998. Favorable
<br />recommendations have been received by the Police Department, Fire Department, Code Enforcement
<br />and the Building Department.
<br />Mr. Timothy Wick, Homier Distributing Company, 84 Commercial Road, Huntington, Indiana, was
<br />Present and recommended approval. There being no one else present wishing to address the Board
<br />concerning this matter, the Public Hearing was closed.
<br />Therefore, upon a motion made by Ms. Roemer, seconded by Mr. Powell and carried, the Application
<br />for a Transient Merchant License was approved.
<br />APPEAL FOR DENIAL OF A TAXI CAB LICENSE - GREGORY ROUSE
<br />Mr. Caldwell advised that this was the date set for an appeal, as requested by Mr. Gregory Rouse,
<br />1237 West Colfax, South Bend, Indiana, concerning a taxi cab driver's license. Mr. Gregory Rouse
<br />was present, and stated that he would like the Board to give a favorable recommendation and approve
<br />his taxi cab license. He wants to work and make this job his livelihood. Ms. Ann Carol Nash,
<br />Assistant City Attorney, was present, and recommended that his request be denied, based on his
<br />criminal history. Mr. Glenn McQueen, South Bend Police Department, was present, and stated that
<br />Mr. Rouse was charged with a D felony from Anderson, Indiana; was charged in 1981 for a felony
<br />theft which was dropped; convicted of a burglary; criminal conversion in 1989; and resisting police
<br />by flight in 1991. His criminal history indicates he should not be granted a taxi cab license. Ms. Nash
<br />stated that he has failed to appear in three instances of a suspended license, and October of 1997 was
<br />the last suspension. He applied for this taxi cab license after October. Additionally, his application
<br />is very sketchy.
<br />Mr. Rouse stated that he is trying to do his best, and that he helps stranded motorists. It appears to
<br />Mr. Rouse that no one is finding the good in him, only the bad.
<br />Therefore, upon a motion made by Ms. Roemer, seconded by Mr. Caldwell and carried, the request
<br />for the issuance of a taxi cab license was denied.
<br />OPENING OF BIDS - EAST WAYNE STREET HISTORIC DISTRICT STREET LIGHTING
<br />UPGRADE - PROJECT NO. 98-56
<br />This was the date set for receiving and opening of sealed bids for the above referred to project. The
<br />Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri-County News
<br />which were found to be sufficient. The following bids were opened and publicly read:
