REGULAR MEETING <br />SEPTEMBER 28.1998 <br />e Enforcement. If after public hearing, the City deternunes TCI is in default of any provision <br />of this franchise agreement, the City may demand TCI comply with the provision; commence <br />an action at law for monetary damages; or, in the case of substantial default of a material <br />provision of the franchise, revoke the franchise. <br />The Board also recognized its limited authority over issues with which many citizens are concerned, <br />such as cable programming and rates, because Congress has made a conscious policy decision in favor <br />of deregulation. With respect to technology, the Cable Act, codified at 47 U.S.C. §521 et seq., <br />specifically dictates that "no State or franchising authority may prohibit, condition, or restrict a cable <br />system's use of any type of subscriber equipment or any transmission technology." Likewise, the City <br />has authority only over TCI's basic rates.
