<br />of a non -capital nature, such as street and road maintenance, within one (1) year of the effective date
<br />of the annexation, in a manner equivalent in standard and scope to the services furnished by the City
<br />to other areas of the City regardless of similar topography, patterns of land utilization, and population
<br />density; and to furnish to said territory services of a capital improvement nature, such as street
<br />lighting, roads, curbs, sidewalks and sanitary sewer facilities, within four (4) years of the effective
<br />date of the annexation in the same manner as those services are provided to areas within the corporate
<br />boundaries of the City of South Bend regardless of similar topography, patterns of land use, or
<br />population density, and in a manner consistent with federal, state and local laws, procedures, and
<br />planning criteria.
<br />Section III. That the Board of Public Works shall and does hereby now establish and adopt
<br />the fiscal plan, attached hereto and made a part hereof, for the furnishing of said services to the
<br />territory to be annexed.

<br />That part of the southeast quarter of Section 31, Township 38 North, Range 2 East, German
<br />Township, St. Joseph County, IN, more particularly described as follows:
<br />Beginning at a point on the east right-of-way line of Oak Road, approximately 703.05 feet
<br />north of the centerline of Edison Road; thence north along the east line of Oak Road
<br />approximately 1,950 feet to the south line of the northeast quarter of Section 31; thence west
<br />along said south line to the northwest corner of the east half of the southeast quarter of said
<br />section; thence south along the west line of the said east half approximately 1,950 feet to a
<br />point approximately 660 feet from the centerline of Edison Road; thence east parallel to the
<br />centerline of Edison Road to the point of beginning.

<br />Upon a motion made by Ms. Roemer, seconded by Mr. Powell and carried, the following Resolution
<br />was adopted by the Board of Public Works. Mr. Larry Magliozzi, Planning, was present, and stated
<br />that this annexation consisted of approximately fifty-two (52) acres, near Oak and Edison Roads.
<br />Police and Fire Services are available, as well as sewer and water.

<br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS
<br />OF THE CITY OF SOUTH BEND
<br />ADOPTING A WRITTEN FISCAL PLAN AND ESTABLISHING A
<br />POLICY FOR THE PROVISION OF SERVICES TO
<br />AN ANNEXED AREA IN GERMAN TOWNSHIP
<br />(CORNERSTONE L.P. ANNEXATION)
<br />WHEREAS, there has been submitted to the Common Council of the City of South Bend,
<br />Indiana, an ordinance which proposes the annexation of the real estate described hereinafter as
<br />Exhibit "A", located in German Township, St. Joseph County, Indiana; and
<br />WHEREAS, the territory proposed to be annexed encompasses approximately 52.33 acres
<br />of unimproved, undeveloped field land located directly on the north side of Edison Road,
<br />approximately 1,400' west of Oak Road, in German Township, St. Joseph County, Indiana, which
