REGULAR MEETING MAY 11, 1998 Also excepting and reserving from said Sublot Eleven (11) One Hundred and Twenty-five (125) feet off of the West end of said lot, heretofore conveyed by Lucinda Kelley to Catherine Polack leaving of said lot after the foregoing exceptions a strip forty-seven and three -fourths (47 3/4) feet in width from East to West fronting on West Huston Street and extending North and South across said Lot Numbered Eleven (11). Key No. 18-3051-1978; A part of Lot Numbered Thirteen (13) as shown on the recorded Plat of J. K. Huston's Subdivision of Bank Out lot Numbered Seventy-two (72) of the First Plat of Out Lots of the Town, now City of South Bend, in St. Joseph County, Indiana, platted by the State Bank of Indiana, which part is described as beginning at the Northwest corner of said Lot Numbered Thirteen (13), running thence East Eighty-nine (89) feet; thence South Twenty-three (23) feet and Eight (8) inches; thence West Eighty-nine (89) feet; thence North to the place of beginning, ALSO a strip of land Three (3) feet in width lying immediately East of the above - described land which shall be used for the purpose of ingress and egress to the above described land with the owners of the land adjoining said Three (3) foot strip on the East, ALSO a tract of land three and one-half (3 '/z) feet in width, North and South, taken off the entire length of the South side of Lot Numbered Twelve (12) as shown on the recorded Plat of J. K. Huston's Subdivision of Bank Out Lot Numbered Seventy-two (72) of the First Plat of Out Lots of the Town, now City of South Bend, in St. Joseph County, Indiana, platted by the State Bank of Indiana, EXCEPTING THEREFROM a tract of land Ten (10) feet in width, East and West, taken off the entire width of the East end thereof, which was dedicated to the public use for an alley by Jacob K. Huston. Key No. 18-3051-1980; and Part of Lot Numbered Thirteen (13) as shown on the recorded Plat of J. K. Huston's Subdivision of Bank Out Lot Number Seventy-two (72) of the First Plat of Out lots of the Town, now City of South Bend, platted by the State Bank of Indiana, which part is described as beginning at the Southwest corner of Lot Thirteen (13), running thence East 89 feet North 23 feet and 8 1/4 inches; thence West 89 feet; thence South to the place of beginning. Key No. 18-3051-1981 WHEREAS, the care, custody and control of City -owned real estate is vested in the Board of Public Works pursuant to I.C. 36-9-6-3 and 36-1-11-1, et seq.; and WHEREAS, South Bend Heritage Foundation, Inc., (hereinafter "SBB ), an Indiana not -for -profit corporation meeting the requirements of I.C. 36-1-11-1(a)(7), desires to obtain ownership of the above -described real estate; and WHEREAS, the use of said property for the West Washington Neighborhood Phase I and Chapin Market Phase II development for such purpose will be beneficial to the community, and the City is willing to transfer said property to SBHF for the aforementioned purpose. NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South Bend, Indiana, as follows: 1) The City shall transfer to SBHF thirty-one (31) parcels of real property more particularly described as follows: Ex. 21 '/z Ft. Side Lot 6 Studebaker & Hines BOL 80, Key No. 18-1045- 1955; 46'/z Ft. E.
