Lot Numbered Eleven (11) in Jacob K. Huston's Subdivision of Bank Out Lot Numbered
<br />Seventy-two (72) of the first Plat of Out Lots of the Town, now the City of South Bend,
<br />platted by the State Bank of Indiana, excepting and reserving from said Sublot Eleven (11)
<br />a strip of land ten (10) feet in width off of the East end of said lot as platted and heretofore
<br />excepted in the Original Deed of said Lot from Jacob K. Huston and Wife, as and for an alley.
<br />Also excepting and reserving from said Sublot Eleven (11) One Hundred and Twenty-five
<br />(125) feet off of the West end of said lot, heretofore conveyed by Lucinda Kelley to Catherine
<br />Polack leaving of said lot after the foregoing exceptions a strip forty-seven and three -fourths
<br />(47 3/4) feet in width from East to West fronting on West Huston Street and extending North
<br />and South across said Lot Numbered Eleven (11). Key No. 18-3051-1978;
<br />A part of Lot Numbered Thirteen (13) as shown on the recorded Plat of J. K. Huston's
<br />Subdivision of Bank Out lot Numbered Seventy-two (72) of the First Plat of Out Lots of the
<br />Town, now City of South Bend, in St. Joseph County, Indiana, platted by the State Bank of
<br />Indiana, which part is described as beginning at the Northwest corner of said Lot Numbered
<br />Thirteen (13), running thence East Eighty-nine (89) feet; thence South Twenty-three (23) feet
<br />and Eight (8) inches; thence West Eighty-nine (89) feet; thence North to the place of
<br />beginning, ALSO a strip of land Three (3) feet in width lying immediately East of the above -
<br />described land which shall be used for the purpose of ingress and egress to the above
<br />described land with the owners of the land adjoining said Three (3) foot strip on the East,
<br />ALSO a tract of land three and one-half (3 '/2) feet in width, North and South, taken off the
<br />entire length of the South side of Lot Numbered Twelve (12) as shown on the recorded Plat
<br />of J. K. Huston's Subdivision of Bank Out Lot Numbered Seventy-two (72) of the First Plat
<br />of Out Lots of the Town, now City of South Bend, in St. Joseph County, Indiana, platted by
<br />the State Bank of Indiana, EXCEPTING THEREFROM a tract of land Ten (10) feet in
<br />width, East and West, taken off the entire width of the East end thereof, which was dedicated
<br />to the public use for an alley by Jacob K. Huston. Key No. 18-3051-1980; and
<br />Part of Lot Numbered Thirteen (13) as shown on the recorded Plat of J. K. Huston's
<br />Subdivision of Bank Out Lot Number Seventy-two (72) of the First Plat of Out lots of the
<br />Town, now City of South Bend, platted by the State Bank of Indiana, which part is described
<br />as beginning at the Southwest corner of Lot Thirteen (13), running thence East 89 feet North
<br />23 feet and 8 1/4 inches; thence West 89 feet; thence South to the place of beginning. Key
<br />No. 18-3051-1981
<br />(hereinafter referred to as the Real Property), and;
<br />WHEREAS, the City of South Bend, Indiana (City), acting by and through the Board of
<br />Public Works, hereby expresses its desire to acquire Real Property from the Commission; and
<br />WHEREAS, Redevelopment is desirous of transferring the Real Property to the City; and
<br />WHEREAS, pursuant to I.C. 36-7-14-3, the South Bend Redevelopment Commission
<br />("Commission") is the governing body of the City of South Bend, Department of Redevelopment and,
<br />pursuant to I.C. 36-7-14-12.2 may dispose of the Real Property; and
<br />WHEREAS, pursuant to I.C. 36-7-14-3, Redevelopment, acting by and through Commission,
<br />may exchange or transfer property with another governmental entity upon terms and conditions
<br />agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions
<br />of each entity.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF
<br />THE CITY OF SOUTH BEND, INDIANA AS FOLLOWS:
<br />That the transfer of the Real Property situated in St. Joseph County, Indiana, and generally
<br />described as follows:
