REGULAR MEETING ' ' MAY 11, 1998 <br />The regular meeting of the Board of Public Works was convened at 9:36 a.m. on Monday, May <br />11,1998, by Board President James R. Caldwell, with Mr. Carl P. Littrell and Ms. M. Catherine <br />Roemer present. Also present was Board Attorney Michelle Engel. Mr. Caldwell welcomed the new <br />Director of Public Works, Mr. Lew Powell, and also thanked Mr. Littrell for filling in as Acting . <br />Director. <br />AGENDA ITEMS ADDED/AGENDA ITEM TABLED <br />Upon a motion made by Mr. Littrell, seconded by Ms. Roemer and carried, three (3) Resolutions <br />were added to the agenda. The Bid Award for Miscellaneous Golf Course Equipment was tabled. <br />APPROVE MINUTES OF PREVIOUS MEETING <br />Upon a motion made by Ms. Roemer, seconded by Mr. Littrell and carried, the minutes of the regular <br />meeting of the Board held on May 4, 1998, were approved. <br />APPEAL DENIED - TAXI CAB DRIVER'S LICENSE - VERNON JOHNSON <br />This was the date set for the appeal of a Taxi Cab Driver's License, as requested by Mr. Vernon <br />Johnson. Ms. Ann Carol Simons, Assistant City Attorney, was present, and stated that Mr. Johnson <br />has a criminal history and a driving record, and should not be permitted to drive a cab. He has <br />speeding violations, driving without a proper license, and numerous failures to appear. The criminal <br />history stems from Mississippi, including robbery and criminal conversion. Detective Glen McQueen, <br />Police Department, was present, and attested to the criminal history of Mr. Johnson. He has accrued <br />five suspensions for driving with an improper license and for failure to appear. In 1984 he had two <br />(2) counts of burglary. By his own admission, Mr. Johnson has not responded to fines or court dates. <br />He presently had a conditional driver's license, based on his last DUI. <br />Mr. Vernon Johnson was present, and stated that the failure to appear in court was his own fault. <br />His conviction was in 1976, over twenty years ago, and he feels that it should not count after twenty <br />years. He has had points on his driver's license down to two (2), but with his first DUI, it went up <br />to ten (10) points on his license. Ms. Simon stated that he has not been driving with a license in the <br />City for the past decade. The taxi company he is working for is under advisement. His last DUI was <br />in December of 1997, for failure to stop at a railroad crossing, and that his continued failure to appear <br />for a court appearance shows a lack of responsibility. Mr. Vernon submitted a form showing his <br />name on Life Treatment Center application. <br />Mr. Johnson stated that the cab companies do not push the drivers to obtain a City license. He stated <br />that eighty percent of the drivers do not have licenses, and have never been asked to obtain them. <br />Ms. Simons replied that the cab companies are aware of their driver's requiring licenses, and the law <br />has remained unchanged. There was no one else present to make a statement. Upon a motion made <br />by Mr. Littrell, seconded by Ms. Roemer and carried, the appeal was denied. <br />OPENING OF BIDS - JANITORIAL SUPPLIES <br />This was the date set for receiving and opening of sealed bids for the above referred to items. The <br />Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri-County News <br />which were found to be sufficient.
