Littrell, Director, Division of Engineering, advised the Board that on March 9, 1998, bids <br />were received and opened for the above referred to project. After reviewing those bids, Mr. Littrell <br />recommends that L.E. Barber's bid be rejected. Under I.C. 36-1 12-4, the Board has the authority <br />to award to other than the lowest bidder, in effect rejecting the work specified. L.E. Barber was a <br />successful bidder, but an unsuccessful contractor in the 1997 program. They failed to complete this <br />work on time. One hundred work sites had to be postponed to the 1998 program. They could not <br />accomplish accordingly with their major subcontractor, and many quality of work issues were raised <br />to the point that some replacement work had to be done. The project is divisible, by the <br />specifications. The specifications also prohibit award of more than two zones to any one company, <br />the lowest bidder having the first preference to the zone or zones they would want to construct. Each <br />of the bidders has been contacted for their preference, presuming rejecting of Barber's bid. The <br />following are Mr. Littrell's recommendations for contract award: <br />Zones 2 and 3 L.L. Geans $333,948.00 <br />Zone 4 Walsh & Kelly $116,438.00 <br />Zones 1 and 5 Niles Concrete $202,537.50 <br />Sufficient funds have been appropriated from the Economic Development Income Tax Fund, the <br />Cumulative Capital Improvement Fund, and from payments from the homeowners. Therefore, Mr. <br />Littrell made a motion that the recommendation be accepted and the bids be awarded as outlined <br />above. Ms. Roemer seconded the motion which carried. <br />AWARD BIDS- ABANDONED VEHICLES <br />Mr. Gary Libbey, Department of Code Enforcement, advised the Board that on March 23, 1998, bids <br />were received and opened for the above referred to project.
