REGULAR MEETING
<br />MARCH 23, 1998
<br />The regular meeting of the Board of Public Works was convened at 9:40 a.m. on Monday, March 23,
<br />1998, by Board Member Carl P. Littrell, with Ms. M. Catherine Roemer present. Board President
<br />James R. Caldwell was not present. Also present was Board Attorney Michelle Engel.
<br />ADD AGENDA ITEMS
<br />Upon a motion made by Ms. Roemer, seconded by Mr. Littrell and carried, the bid award for 1998
<br />Computer Purchases and a contract for Emergency Medical Services was added to the agenda.
<br />APPROVE MINUTES OF PREVIOUS MEETING
<br />Upon a motion made by Ms. Roemer, seconded by Mr. Littrell and carried, the minutes of the regular
<br />meeting of the Board held on March 16, 1998, were approved.
<br />PUBLIC HEARING - APPLICATION FOR TRANSIENT MERCHANT LICENSE - "BOOKS
<br />ARE FUN"
<br />Mr. Littrell advised that this was the date set for the Board's Public Hearing concerning a License
<br />Application for a Transient Merchant License, as submitted by Kathleen and Joseph Saylor, 3661 4th
<br />Road, Bremen, Indiana, to conduct the sale of books as various locations throughout 1998, more
<br />particularly described in the schedule as submitted. Mr. Littrell stated that favorable
<br />recommendations have been received by the Police Department, Fire Department, Building
<br />Commissioner and the City Attorney's Office.
<br />Mr. Joseph Saylor, 3661 4th Road, Bremen, Indiana, was present, and recommended approval.
<br />There being no one else present wishing to address the Board concerning this matter, the Public
<br />Hearing was closed. Therefore, upon a motion made by Mr. Littrell, seconded by Ms. Roemer and
<br />carried, the License Application was approved.
<br />PUBLIC HEARING - APPLICATION FOR TRANSIENT MERCHANT LICENSE - VILLAGE
<br />WEST ENTERPRISES, INC.
<br />Mr. Littrell advised that this was the date set for the Board's Public Hearing concerning an
<br />Application for a Transient Merchant License, as submitted by Ms. Rita Stansu, 8180 North 150
<br />West, Lake Village, Indiana, to conduct the sale of rifles, shotguns and pistols at Union Station on
<br />April 4 and 5 and November 7 and 8, 1998. Mr. Caldwell stated that favorable recommendations
<br />were received from the Building Department, Police Department, Fire Department and the Legal
<br />Department.
<br />Mr. Tim Johnson, Union Station, was present, and recommended approval. There being no one else
<br />present wishing to address the Board concerning this matter, the Public Hearing was closed.
<br />Therefore, upon a motion made by Mr. Littrell, seconded by Ms. Roemer and carried, the License
<br />Application was approved.
<br />APPEAL DENIED - TAXI CAB DRIVER'S LICENSE - THOMAS J SCHEUER
<br />Mr. Littrell advised that this was the date set for the Boards' hearing of an appeal for a taxi cab
<br />driver's license, as requested by Mr. Thomas J. Scheuer, 1726 Sunnymede Avenue, South Bend,
<br />Indiana.
<br />Mr. Thomas J. Scheuer, as well as his attorney, Mr. Jay Lauer, was present. Mr. Littrell asked Mr.
<br />Scheuer if he had operated a taxi cab without a license, as the letter from the City Attorney's office
<br />had indicated. Mr. Lauer replied that he thought the denial was based on another issue. Mr. Scheuer
<br />stated that he had is own cab and that it has been inspected. He stated that his license was suspended
<br />that he went back to work at the bus company, but that he had a Mishawaka license. Mr. Scheuer
<br />said that he had picked up pharmaceutical items in South Bend, as well as sometimes dropping off
<br />passengers, which originated in Mishawaka. Ms. Ann Carol Simons indicated the South Bend
<br />Municipal Code indicates "operating in South Bend without a license". Ms. Simons also stated he
<br />has a poor driving record. Mr. Scheuer stated that he has gone to Alcoholics Anonymous several
<br />months ago, and has not had a drink since 1997. He lives with his father, who can attest to his
<br />character.
