REGULAR MEETING <br />FEBRUARY 16, 1998 <br />The regular meeting of the Board of Public Works was convened at 9: 3 5 a.m. on Monday, February <br />16, 1998, by Board President James R. Caldwell, with Mr. Carl P. Littrell and Ms. M. Catherine <br />Roemer present. Also present was Board Attorney Michelle Engel. <br />ADD AGENDA ITEMS <br />Upon a motion made by Ms. Roemer, seconded by Mr. Littrell and carried, the following items were <br />added to the agenda: <br />- Request to Advertise for Receipt of Bids - Morris Civic (Two (2) Bid Packages) <br />- Request to Advertise for Receipt of Bids - Computer <br />- Amendment to Resolution No. 9-1998 <br />APPROVE MINUTES OF PREVIOUS MEETING <br />Upon a motion made by Ms. Roemer, seconded by Mr. Littrell and carried, the minutes of the regular <br />meeting of the Board held on February 9, 1998, were approved. <br />APPEAL - TAXI CAB LICENSE - PATRICK EVERLY <br />Mr. Caldwell advised that this was the date set for an appeal concerning the denial of a taxi cab <br />driver's license, as submitted by Mr. Patrick Everly, % Hickory Inn Budget Motel, 50520 U.S. 33 <br />North, South Bend, Indiana. <br />Mr. Patrick Everly was present, as well as Ms. Ann Carol Simons, City Attorney's office, and <br />Detective Glenn McQueen, South Bend Police Department. Mr. Caldwell stated that initially Mr. <br />Everly's request was denied, as he had a criminal history. The City of South Bend Municipal Code <br />states that an individual convicted of a felony is subject to denial when pursuing this type of license. <br />Mr. Everly stated that this felony was sixteen (16) years old. He stated that he is disabled, and this <br />is the only work he can perform. Ms. Simons stated that in addition to the felony, he has had a <br />speeding ticket, amounting to four (4) points on his driver's license, and an indication of interaction <br />with the law enforcement in Ohio. Detective McQueen stated that a nationwide history check <br />revealed he has a criminal history in Texas and Ohio. Mr. Everly responded that the conviction in <br />1982 was a forgery conviction, and he was put on probation. He failed to pay, and received six (6) <br />months jail time. <br />Mr. Caldwell stated that his felony history is a concern to the Board due to the criminal history and <br />driving record. The speeding ticket was in May of 1997, before the application was filed. Ms. <br />Simons stated that cab drivers are responsible for large amounts of cash, a trip log and providing <br />information to the Police Department upon request. An individual convicted of forgery may not be <br />an honest person in regard to handling of cash and uith passengers. Mr. Walter Jones, ABC Cab <br />Company, was present, and stated that Mr. Everly has worked for his cab company, and can give a <br />good reference for him. Mr. Jones knows Mr. Everly and trusts him, and stated that he is fit to drive <br />a cab. Mr. Jones was willing to take a chance in hiring Mr. Everly. At present time, he is a courier <br />for ABC Cab, and he does not believe Mr. Everly to be a risk. Mr. Everly stated that his ticket for <br />speeding was 45 mph in a 35 mph zone, and he paid the ticket with no altercations with the law. He <br />also stated that he has been honest, and has not tried to hide the felony conviction nor the speeding <br />ticket. <br />Therefore, upon a motion made by Mr. Littrell, seconded by Ms. Roemer and carried, the appeal for <br />a taxi cab license was approved. <br />OPENING OF BIDS - SALE OF SELF-CONTAINED BREATHING APPARATUS <br />This was the date set for receiving and opening of sealed bids for the sale of the above referred to <br />items. The Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri- <br />County News which were found to be sufficient.
