REGULAR MEETING
<br />MARCH 29, 1999
<br />The regular meeting of the Board of Public Works was convened at 9:33 a.m. on Monday, March 29,
<br />1999, by Board President James R. Caldwell, with Mr. Lewis N. Powell and Ms. M. Catherine
<br />Roemer present. Mr. Brian Steinke, Assistant City Attorney, was present. Attorney Michelle Engel
<br />was not present.
<br />ADD AGENDA ITEMS
<br />Upon a motion made by Mr. Powell, seconded by Ms. Roemer and carried, the following items were
<br />added to the agenda:
<br />- Title Sheet - East Bank Walkway Phase II
<br />- Request for Approval of Plans and to Advertise Public Information Meeting - East Bank Walkway
<br />Phase II
<br />- Temporary Street Sign Name Changes
<br />- Appointment of Resident Project Representative - East Bank Walkway II
<br />APPROVE MINUTES OF PREVIOUS MEETING
<br />Upon a motion made by Mr. Powell, seconded by Mr. Caldwell and carried, the minutes of the
<br />regular meeting of the Board held on March 22, 1999, were approved.
<br />PUBLIC HEARING -_TRANSIENT MERCHANT LICENSE - 4H FAIR GROUNDS
<br />Mr. Caldwell advised that this was the date set for the Board's Public Hearing concerning an
<br />Application for a Transient Merchant License, as submitted by Mr. Frank Ronchetti, St. Joseph
<br />County 4H Fair Grounds, 5117 South Ironwood, South Bend, Indiana, for a blanket Transient
<br />Merchant License for 1999. Mr. Caldwell stated that favorable recommendations have been received
<br />by the Police Department, Fire Department and the Building Commissioner.
<br />Mr. Frank Ronchetti, 4H Fair Grounds, was present and recommended approval. There being no one
<br />else present wishing to address the Board concerning this matter, the Public Hearing was closed.
<br />Therefore, upon a motion made by Ms. Roemer, seconded by Mr. Caldwell and carried, the Transient
<br />Merchant License Application was approved.
<br />PUBLIC HEARING - TRANSIENT MERCHANT LICENSE - NATIONAL COMPUTER SALES
<br />Mr. Caldwell advised that this was the date set for the Board's Public Hearing concerning an
<br />Application for a Transient Merchant License, as submitted by Mr. Ali Khatib, 1536 State College
<br />Boulevard, Anaheim, California, to conduct the sale of TV's, microwaves, phones, stereos,
<br />computers and accessories, on April 9-11, 1999, at the 4H Fair Grounds. Mr. Caldwell stated that
<br />favorable recommendations have been received by the Police Department, Fire Department and the
<br />Building Commissioner.
<br />As the 4H Fair Grounds received a "blanket" Transient Merchant License for all their events in 1999,
<br />this item was not addressed. Upon a motion made by Mr. Caldwell, seconded by Mr. Powell and
<br />carried, the License was tabled.
<br />APPEAL ON DENIAL OF TAXICAB DRIVER'S LICENSE - JAMES NAPIER
<br />Mr. Caldwell advised that this was the date set for the Board's hearing for an appeal, as requested
<br />by Mr. James Napier, South Bend, Indiana, for a taxi cab driver's license. Detective Glenn McQueen,
<br />South Bend Police Department, was present, and stated that Mr. Napier has had felony convictions
<br />for burglary, cocaine dealing, assault, and domestic violence, of which the most recent occurred in
<br />November of 1996.Mr. Napier has been out of prison for two (2) months, as is on parole. Detective
<br />McQueen stated that he is concerned with the lengthy record of criminal activity.
<br />Mr. Napier was present, and stated that he has served his time for his crimes, and that his parole
<br />officer gave him a letter to travel out of the state for jobs. He stated that he has been driving for
<br />Roseland Cab and Federal Express.
<br />Ms. Ann Carol Nash was present, and stated that due to the nature of the offenses of violence, she
<br />recommends a denial for a taxi cab driver's license.
