<br />REGULAR MEETING
<br />FEBRUARY 1, 1999
<br />The regular meeting of the Board of Public Works was convened at 9:34 a.m. on Monday, February
<br />1, 1999, by Board Member Lewis N. Powell, with Ms. M. Catherine Roemer present. Also present
<br />was Board Attorney Michelle Engel. Board Member James R. Caldwell was not present.
<br />ADD AGENDA ITEM
<br />Upon a motion made by Ms. Roemer, seconded by Mr. Powell and carried, the 1998 and 1999 Med
<br />Benefits Summary Plan Descriptions for Police, Fire, Teamsters and Non -Bargaining employees were
<br />added to the agenda.
<br />APPROVE MINUTES OF PREVIOUS MEETING
<br />Upon a motion made by Ms. Roemer, seconded by Mr. Powell and carried, the minutes of the regular
<br />meeting of the Board held on January 25, 1999, were approved.
<br />PUBLIC HEARING - TRANSIENT MERCHANT LICENSE - MICHIANA BOAT AND
<br />`r OUTDOOR SHOW
<br />Mr. Powell advised that this was the date set for the Board's Public Hearing concerning an
<br />Application for a Transient Merchant License, as submitted by Mr. Melvin Wood, 15030 Stransbury
<br />Court, Granger, Indiana, to conduct the sale of boats and fishing equipment at the Century Center,
<br />on February 26 through 28, 1999. Mr. Caldwell stated that favorable recommendations have been
<br />received by the Police Department, Fire Department, Building Commissioner and the Legal
<br />Department.
<br />Mr. Melvin Wood, 15030 Stransbury Court, Granger, Indiana, was present, and recommended
<br />approval. There being no one else present wishing to address the Board concerning this matter, the
<br />Public Hearing was closed. Therefore, upon a motion made by Ms. Roemer, seconded by Mr. Powell
<br />and carried, the License Application was approved.
<br />TAXI DRIVER'S LICENSE APPEAL - RALPH ALVAREZ - DENIED
<br />..., Mr. Powell advised that this was the date set for an Appeal for a taxi cab driver's license, as
<br />requested by Mr. Ralph Alvarez, 521 Lincolnway West, South Bend, Indiana.
<br />It was noted that an appeal was originally set for January 25, 1999, at the regular Board of Public
<br />Works meeting at 9:30 a.m. At that meeting, Ms. Ann Carol Nash, Assistant City Attorney,
<br />recommended that the taxi cab driver's license be denied, based on a background check by the South
<br />Bend Police Department, as discussed at the meeting.
<br />Mr. Alvarez was present, and stated that he originated from East Chicago, Indiana. In 1955, at age
<br />sixteen, Mr. Alvarez stated he had stolen a vehicle, was conficted of a felony, and served at the
<br />Indiana Reformatory. He was convicted of a felony in 1967 was sentenced again to the Indiana
<br />Reformatory. In 1964-1965, he was convicted of armed robbery and served eight years. At thirty-
<br />three years old, Mr. Alvarez came to South Bend and became a drug addict. Mr. Alvarez presented
<br />documentation to the Board describing a Certificate of Completion in a drug abuse program, as well
<br />as an achievement of his G.E.D. He is currently residing at a pilot home, and is on parole for two
<br />years. Mr. Alvarez stated that he is sixty years old and would like to better himself. Additionally,
<br />he stated that he has a very good driving record, and recommended the Board approve his taxi cab
<br />driver's license application.
<br />The Board stated that the primary function of the Board is be concerned with the safety and welfare
<br />of taxi cab passengers. Therefore, upon a motion made by Ms. Roemer, seconded by Mr. Powell and
<br />carried, the taxi cab driver's license application was denied.

<br />Mr. Fred Lusk, Verkler, Inc., 4406 Technology Drive, South Bend, Indiana, and Cleo Hickey,
<br />Director, Morris Performing Arts Center, advised the Board that on January 11, 1999, bids were
