1 <br />REGULAR MEETING JANUARY 25. 1999 <br />The regular meeting of the Board of Public Works was convened at 9:40 a.m. on Monday, January <br />25, 1999, by Board President James R. Caldwell, with Mr. Lewis N. Powell and Ms. M. Catherine <br />Roemer present. Also present was Board Attorney Michelle Engel. <br />ADD/TABLE AGENDA ITEMS <br />Upon a motion made by Ms. Roemer, seconded by Mr. Caldwell and carried, the following items <br />were added to the agenda: <br />- Public Hearing Transient Merchant License - "Shipshewana on the Road" <br />- Change Order - Leighton Plaza <br />Further, upon a motion made by Mr. Caldwell, seconded by Ms. Roemer and carried, the following <br />agenda items were tabled: <br />- Agreement - Intergovernmental Agreement - Hickory/Corby Signals <br />- Title Sheets - Secondary Clarification Project and Headworks Facility <br />- Public Hearing - Transient Merchant License - Michiana Boat and Outdoor Show <br />APPROVE MINUTES OF PREVIOUS MEETING <br />Upon a motion made by Ms. Roemer, seconded by Mr. Powell and carried, the minutes of the regular <br />meeting of the Board held on January 18,1999, were approved. <br />APPEAL - TAXI CAB DRIVER'S LICENSE - RALPH ALVAREZ <br />This was the date set for the Board's appeal in the matter of a denial for a taxi cab driver's license, <br />as requested by Mr. Ralph Alvarez, 532 South Michigan, South Bend, Indiana. It was noted that <br />Mr. Ralph Alvarez was not present for this appeal. <br />Ms. Ann Carol Nash, Assistant City Attorney and Detective Glen McQueen, South Bend Police <br />Department were present. Ms. Nash stated that Mr. Alvarez' criminal history goes back to 1955, <br />through 1993. Mr. Alvarez was convicted of a Class B felony in 1993 for heroin, and a suspended <br />driver's license. In addition, he was arrested for forgery and robbery. Mr. Alvarez could not <br />account for specific dates in his application, and it could be that these times were when he was <br />incarcerated. Detective McQueen stated that in 1987 and 1993 he was convicted of dealing a <br />controlled substance. Ms. Nash recommended that based on Mr. Alvarez' criminal history, his taxi <br />cab driver's license should be denied. Upon a motion made by Ms. Roemer, seconded by Mr. Powell <br />and carried, Mr. Alvarez' taxi cab license was denied. Mr. Caldwell asked Ms. Nash to forward a <br />letter to Yellow Cab and Allied Cab to advise them his license was denied. <br />OPENING OF BIDS - ABANDONED VEHICLES <br />This was the date set for receiving and opening of sealed bids for the above referred to vehicles. The <br />Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri-County News <br />which were found to be sufficient.
